Article 2 These regulations apply to all types of enterprises engaged in production and business activities in accordance with the law within the administrative region of this province.

The term "enterprise managers" as mentioned in these Regulations refers to the company's chairman of the board, managers, factory directors and other principal persons in charge. Article 3 People's governments at all levels shall strengthen leadership over the protection of the legitimate rights and interests of enterprises and business managers, organize, coordinate and urge relevant departments to do a good job in protecting the legitimate rights and interests of enterprises and business managers, and promptly stop infringements on enterprises and business managers. Acts that operate on the legitimate rights and interests of managers. Article 4 Relevant administrative departments and judicial organs shall administer according to law, administer justice fairly, and provide civilized services, maintain the order of enterprise production and operation, and protect the legitimate rights and interests of enterprises and enterprise managers. Article 5 Enterprise federations, entrepreneur federations, chambers of commerce, and various industry associations shall protect the legitimate rights and interests of enterprises and enterprise managers in accordance with the law, reflect the suggestions and requirements of enterprises and enterprise managers, and provide services for enterprises and enterprise managers. who provide services. Article 6 When enterprises and business managers engage in production and business activities, they shall abide by laws, regulations and rules, follow the principles of good faith and fair competition, and shall not damage national interests, social welfare interests, or the legitimate rights and interests of employees and others. Article 7 Natural persons, legal persons or other organizations have the right to report and expose behaviors that harm the legitimate rights and interests of enterprises and enterprise managers.

News media should conduct public opinion supervision of behaviors that harm the legitimate rights and interests of enterprises and business managers. Article 8 Enterprises enjoy the right to operate independently within the approved and registered business scope in accordance with the law, and no unit or individual may illegally interfere.

Relevant administrative departments and judicial organs shall not suspend the legitimate production and operation activities of enterprises when dealing with business managers suspected of violating the law. Article 9 The legitimate investments and legitimate earnings of enterprises and their investors shall be protected by law. No unit or individual may misappropriate the property and legitimate rights and interests of enterprises and business managers, may not illegally charge or fine enterprises, and may not apportion property to enterprises. Article 10 Relevant administrative departments and judicial organs shall protect intellectual property rights and business secrets such as patent rights, trademark rights, and copyrights obtained by enterprises and business managers in accordance with the law.

No unit or individual may infringe the intellectual property rights and business secrets of enterprises and business managers. Anyone who violates the regulations shall bear corresponding legal responsibilities in accordance with the law. Article 11 People's governments at all levels and their relevant departments shall not illegally restrict foreign products or services from entering the local market or hinder fair competition.

Enterprises and business managers have the right to boycott violations of the provisions of the preceding paragraph and report them to the next higher level government or the relevant administrative department. The relevant government or its administrative department shall keep the whistleblower confidential and investigate and deal with it in accordance with the law. Article 12 If imported products are dumped, subsidized or increased in quantity, and cause substantial damage or threat of substantial damage to relevant industries, relevant enterprises may themselves or entrust relevant social organizations to submit anti-dumping or countervailing duties to the relevant national administrative departments in accordance with the law. Application for investigation or safeguard measures.

If export products are subject to anti-dumping, countervailing or safeguard measures investigation, the relevant administrative departments of the provincial people's government shall support the enterprises involved in the case in responding to the lawsuit, and may organize and coordinate the response work as entrusted by the relevant national administrative departments. .

When enterprises encounter unfair treatment from foreign countries in export trade, they can report it to the relevant administrative departments of the Provincial People's Government and cooperate with the relevant national administrative departments in conducting investigations and negotiations on trade barriers. Article 13 When relevant state agencies formulate laws, regulations and normative documents involving the rights and interests of enterprises and business managers, they shall listen to the opinions and suggestions of enterprises and business managers. Article 14 It is prohibited to use illegal detention or other methods that illegally restrict the personal freedom of enterprise managers to resolve economic disputes.

For those who violate the provisions of the preceding paragraph, after receiving the report, the public security organs and judicial organs shall promptly provide assistance and investigate and deal with the violation in accordance with the law. Article 15 No unit or individual may invade or search the workplace or residence of an enterprise manager without the approval of the authorities prescribed by law.

Article 16 If enterprises and business managers believe that specific administrative actions of administrative agencies infringe upon their legitimate rights and interests, they may themselves or entrust relevant social organizations to apply for administrative reconsideration or initiate administrative litigation in accordance with the law; If there is any damage, you may apply for state compensation in accordance with the law. Article 17 If acts that infringe upon the legitimate rights and interests of enterprises and business managers do not fall within the scope of administrative reconsideration or administrative litigation, enterprises and business managers may report or complain to the relevant administrative departments on their own or by entrusting relevant social organizations to do so. The relevant administrative departments shall keep the reports and complaints confidential, handle them in accordance with the law within 60 days, and respond in writing to the report and complainants; the relevant administrative departments shall not refuse to accept the reports or complaints, and if they believe that they do not fall within the responsibilities of the department, they shall, upon receipt of the reports, , Transfer the complaint to other relevant departments within 5 days from the date of complaint.

If the time limit specified in the preceding paragraph is stipulated in laws or regulations, such provisions shall prevail.
