The category of design products should be divided into sub-categories containing the upper concept of the use of products in the design classification table; If there is no subclass containing the superior concept used by the product, it should be classified as a miscellaneous category containing the superior concept used by the product; Those products that do not contain the upper concept of product use should be classified into miscellaneous categories in the classification table.
The classification number consists of a large class number and a small class number. The large category number and the small category number are represented by two Arabic numerals respectively; If it is less than two digits, add 0 to 9 before the number 1; Dashes are used to connect large category numbers with small category numbers. For example, the classification number of TV sets is 14-03. In addition, for multi-category products, multiple classification numbers are separated by semicolons.
Classification of disposable products
If a design product or a set of products has only one purpose, a classification number is given.
Classification of multi-purpose products
When a design product is a combination of two or more products with different uses, the examiner can give multiple classification numbers (generally two) corresponding to its uses. The classification number determined by the main use of the product is the main classification number, and the classification number determined by the secondary use is the sub-classification number. Generally speaking, the use embodied in the main or larger part of the product appearance is the main use, and the use embodied in the secondary or smaller part of the product appearance is the secondary use. For example, for an alarm clock with a radio, if the major or larger part of the product appearance is used as an alarm clock and the minor or smaller part of the product appearance is used as a radio, its major classification number is 10-0 1, and its sub-classification number is 14-0 1.
Three-level classification correction notice
If the applicant fails to specify the product category, and fails to specify the use field, purpose, method or place in the brief description, or the use field, purpose, method or place recorded in the brief description is inaccurate, the examiner may issue a notice of classification correction, requiring the applicant to specify the use field, purpose, method or place of the product. When necessary, the applicant may also be required to submit a reference diagram of the product's use status.
The applicant shall reply within one month after receiving the notice of classification correction. If the applicant fails to reply or does not meet the requirements after the expiration, the examiner shall give the classification number according to the application documents.
