The term "scientific and technological achievements" as mentioned in these Regulations refers to achievements of practical value produced through scientific research and technological development, including patented technology and computer software, layout design of integrated circuits, new plant varieties, design drawings, test results, test records, processes, processes, formulas, samples and data, and other non-patented technologies and information.
The term "transformation of scientific and technological achievements" as mentioned in these Regulations refers to the subsequent testing, development, application and promotion of scientific and technological achievements in order to improve the level of productivity until new technologies, new processes, new materials, new products, new services and new standards are formed and new industries are developed. Article 3 The transformation of scientific and technological achievements should follow the scientific and technological innovation and market rules, give full play to the main role of enterprises and the guiding role of the government, embody the value distribution orientation of intellectual labor, follow the principles of voluntariness, mutual benefit, fairness, honesty and credit, strengthen the protection of intellectual property rights and safeguard the interests of all parties involved in the transformation of scientific and technological achievements. Article 4 The people's governments at or above the county level shall strengthen their leadership over the transformation of scientific and technological achievements, incorporate the transformation of scientific and technological achievements into the national economic and social development plan and the government performance evaluation system, and coordinate policies on science and technology, education, finance, investment, taxation, talents, industry, finance, intellectual property rights, government procurement and integration of defense and civilian technologies, so as to create a good environment for the transformation of scientific and technological achievements.
The competent department of science and technology and other relevant departments shall manage, guide, coordinate and serve the transformation of scientific and technological achievements within their respective functions and duties.
Township people's governments and sub-district offices shall assist relevant departments in the transformation of scientific and technological achievements. Fifth people's governments at or above the county level shall reward units and individuals that have made outstanding contributions in the transformation of scientific and technological achievements.
The science and technology awards established by the provincial people's government and the Ningbo Municipal People's government in accordance with state regulations should focus on scientific and technological achievements that have achieved remarkable economic, social and ecological benefits. Chapter II Organization and Implementation Article 6 The competent department of science and technology shall, jointly with other relevant departments, formulate a work plan for the transformation of scientific and technological achievements, issue a work guide for the transformation of scientific and technological achievements, and guide the transformation activities of scientific and technological achievements according to the national and provincial industrial policies and local national economic and social development plans.
The work guide for the transformation of scientific and technological achievements stipulated in the preceding paragraph shall specify the national and provincial industrial policies, industrial planning, preferential policies related to the transformation of scientific and technological achievements, key scientific and technological achievements transformation projects, and technical trading norms. Encourage the undertakers of scientific and technological projects established with non-financial funds to submit relevant scientific and technological reports and submit scientific and technological achievements and related intellectual property information to the scientific and technological achievements information system, and the relevant departments shall provide convenience for them. The scientific and technological report submitted by the undertaker of scientific and technological projects established with non-financial funds can be used as a reference for the relevant departments to identify their research and development activities and enjoy preferential fiscal and taxation policies. Article 8 The people's governments at or above the county level and their relevant departments shall establish a technological innovation system with enterprises as the main body, market-oriented and closely integrated with Industry-University-Research, and give play to the leading role of enterprises in the selection of research and development direction, project implementation and application of results. Science and technology projects with market application prospects established with financial funds can be organized and implemented by enterprises.
Encourage and support qualified enterprises to establish or jointly establish R&D institutions such as high-tech R&D centers, enterprise research institutes, engineering research (technology) centers, enterprise technology centers, key laboratories, engineering laboratories, academician workstations, enterprise postdoctoral research centers, doctoral or master's practice bases, master's studios, etc., so as to improve the independent innovation and transformation ability of scientific and technological achievements of enterprises. Article 9 Enterprises are encouraged to use public service platforms such as the government science and technology information network to publish scientific and technological achievements and their transformation cooperation information.
The competent department of science and technology and other relevant departments shall, according to the division of responsibilities, provide support and help for enterprises to obtain the needed scientific and technological achievements. Tenth support enterprises to undertake scientific and technological achievements of research and development institutions and institutions of higher learning and implement transformation. For enterprises undertaking scientific and technological achievements, the people's governments at or above the county level may give subsidies according to the actual turnover of technology contracts or a certain proportion of investment in scientific and technological achievements. Eleventh encourage enterprises to make rational and effective use of foreign capital and foreign advanced technology, equipment and management experience, and implement the transformation of scientific and technological achievements.
Support the construction of international science and technology cooperation bases, international science and technology business incubators and international technology transfer platforms. Take the dominant enterprises as the main body, and unite domestic and foreign R&D institutions, universities and other enterprises and institutions.
Encourage enterprises to establish and improve the incentive distribution mechanism for the transformation of scientific and technological achievements, and encourage scientific and technological personnel to implement the transformation of scientific and technological achievements through equity sale, equity incentives, stock options, project income dividends, post dividends, etc.
