Regulations on the Safety Supervision and Administration of Military Nuclear Facilities in National Defense Science and Technology Industry

Chapter 1 General Provisions Article 1 is to implement the safety supervision and management of military nuclear facilities in the national defense science and technology industry (hereinafter referred to as military nuclear facilities), ensure the safety of military nuclear facilities, and protect the health of facility workers and the public, These regulations are formulated to protect the environment and promote the smooth development of the national defense nuclear science and technology industry. Article 2 These regulations apply to the safety supervision and management of the following military nuclear facilities: (1) Production, processing, storage of nuclear materials and spent fuel reprocessing facilities; (2) Nuclear power plants; (3) Various land-based reactors, Including production reactors, research reactors, test reactors, critical devices, etc.; (4) Radioactive waste management facilities; (5) Other military nuclear facilities that require supervision and management. Except for nuclear facilities delivered to the military. Article 3 The siting, design, construction, operation and decommissioning of military nuclear facilities must implement the "safety first" policy and achieve the following safety objectives: (1) Establish and maintain effective defense measures to protect staff and the public and the environment from radiation hazards; (2) Ensure that the radiation exposure of workers and the public when the facility is in operation is below the national prescribed limit and is maintained as low as reasonably achievable to ensure that radiation exposure caused by accidents is mitigated ; (3) Take all reasonable and feasible measures to prevent the occurrence of accidents and mitigate the consequences of accidents. Ensure that the radiological consequences of all accidents considered in the design of the facility are acceptable and that the likelihood of those accidents that may result in serious radiological consequences is sufficiently low. Chapter 2 Supervision and Management Responsibilities Article 4 The Commission of Science, Technology and Industry for National Defense (hereinafter referred to as the Commission for National Defense) shall implement unified safety supervision and management of military nuclear facilities. Its main responsibilities are: (1) Organizing the drafting and formulation of relevant safety laws, regulations and safety standards; (2) Responsible for organizing safety reviews and approving the issuance or revocation of relevant safety licenses; (3) Responsible for implementing safety supervision and inspections; 4) Supervise and coordinate the formulation and implementation of nuclear accident emergency plans; (5) Responsible for safety law enforcement and the investigation and handling of accidents and incidents; (6) Mediate safety disputes with relevant departments; (7) Organize relevant safety research and operational experience feedback. Article 5 The Commission of Science, Technology and Industry for National Defense shall, in accordance with the needs of safety supervision and management of military nuclear facilities, establish corresponding institutions that independently exercise safety supervision and management powers, equip them with necessary and suitable personnel, and form a military nuclear facility safety expert committee. The Safety Expert Committee provides consultation on major matters such as the formulation of safety policies and regulations and rules for military nuclear facilities, the issuance of licenses, and the determination of safety research plans. Article 6 The operating unit shall be fully responsible for the safety of the applied military nuclear facilities. Its main responsibilities are: (1) Comply with relevant national laws, regulations and rules, and formulate corresponding measures; (2) Ensure that the site selection, design, construction, commissioning, operation and decommissioning of facilities comply with relevant national laws, regulations, rules and regulations. Standard requirements are sufficient to ensure safety; (3) Provide the resources needed to ensure the safety of facilities, equip them with sufficient qualified staff, and provide them with adequate training and regular retraining; (4) Accept safety supervision from the Commission of Science, Technology and Industry for National Defense Management; (5) Report the safety status of facilities in a timely and truthful manner and provide relevant information. Article 7 The safety supervision and management implemented for military nuclear facilities does not relieve or transfer the operating unit's overall safety responsibility for the facilities applied for. The safety responsibilities of the operating unit will not change due to the respective activities and responsibilities of designers, suppliers, builders, etc. Chapter 3 Safety Licensing System Article 8 A safety licensing system shall be implemented for military nuclear facilities. Safety license documents include: (1) Military nuclear facility site selection review opinion; (2) Military nuclear facility construction license; (3) Military nuclear facility installation (material delivery) and commissioning approval letter; (4) Military nuclear facility operation license Certificate; (5) Military nuclear facility decommissioning approval letter; (6) Military nuclear facility safety critical position operator license; (7) Other required approval documents. Various activities related to military nuclear facilities must comply with the conditions specified in the corresponding safety license. Article 9 The site of a military nuclear facility must undergo a safety review organized by the Commission of Science, Technology and Industry for National Defense based on the site selection section in the "Feasibility Study Report" and issue a "Site Selection Review Opinion" to confirm the suitability of the selected site from a safety perspective Approval can only be granted after sexual intercourse.

Article 10 Before the construction of a military nuclear facility (including reconstruction and expansion) begins, its operating unit must submit an application for the construction of a military nuclear facility, a preliminary safety analysis report and other relevant information to the Commission of Science, Technology and Industry for National Defense, and upon review and approval, obtain the "Military Nuclear Facilities" Construction can only begin after obtaining the Facility Construction Permit. Article 11 Before the start-up and operation of a military nuclear facility, its operating unit must submit an application for the start-up and operation of a military nuclear facility, a final safety analysis report and other relevant information to the Commission of Science, Technology and Industry for National Defense, and upon review and approval, obtain the "Military Nuclear Facilities" Only after obtaining the "Approval Letter for Loading (Debugging) Fuel and Commissioning" can the fuel be loaded or dropped for start-up debugging. Only after obtaining the "Military Nuclear Facility Operation License" can it be officially operated. Article 12 Before the decommissioning of a military nuclear facility begins, its operating unit must submit an application for decommissioning of military nuclear facilities, a decommissioning safety analysis report and other relevant information to the Commission of Science, Technology and Industry for National Defense. Upon review and approval, the "Military Nuclear Facilities Decommissioning Approval" will be obtained. Only then can retirement activities begin. The final state of decommissioning of military nuclear facilities must be inspected and accepted by the Commission of Science, Technology and Industry for National Defense in conjunction with relevant departments, and the responsibility of the operating unit can be terminated only after it is confirmed that it meets relevant safety requirements. Article 13 For military nuclear facilities that were under construction, in service or decommissioned before the promulgation of these regulations, their operating units shall submit corresponding applications and submit relevant safety analysis reports and information to the Commission of Science, Technology and Industry for National Defense within the prescribed period. Obtain required security clearance documents. Article 14 Only personnel who have obtained and held the operator (operator) license for safety-critical positions of military nuclear facilities can operate in the corresponding safety-critical positions; those who have a college education or above and have served as operators (operators) for safety-critical positions for more than two years Only those with excellent performance can guide others to operate in corresponding safety-critical positions. Article 15 The issuance of safety licenses for military nuclear facilities is based on safety review. Only when the Commission of Science, Technology and Industry for National Defense confirms that the operating unit's application complies with relevant national laws, regulations and rules and meets relevant safety requirements can it issue the corresponding safety license. Article 16 The security license shall be terminated upon expiration; for changes, extensions or replacements of the security license, an application must be submitted to the Commission of Science, Technology and Industry for National Defense, and will be valid only after review and approval. No legal person or individual may transfer any security license obtained in accordance with these regulations without the approval of the Commission of Science, Technology and Industry for National Defense. Chapter 4 Safety Supervision and Inspection Article 17 The basis for safety supervision and inspection of military nuclear facilities is: (1) Relevant national laws, regulations and rules; (2) Relevant national standards, national military standards and nuclear industry standards; (3) ) Conditions stipulated in the security license; (4) Other binding documents. Article 18 The tasks of safety supervision and inspection of military nuclear facilities include: (1) Reviewing whether the safety documents and information submitted by the applicant are realistic; (2) Supervising and inspecting the site selection, design, construction, commissioning, operation and decommissioning of the facilities Whether it complies with the conditions stipulated in relevant laws, regulations, rules and standards and corresponding safety licenses, and whether it meets the predetermined technical requirements; (3) Supervise and inspect whether safety-related activities are carried out in accordance with the design, procedures and quality assurance program approved by the review; (4) Examine whether the operating unit has the capabilities and measures to ensure the safe operation of facilities and implement emergency plans; (5) Assess the safety culture of the operating unit; (6) Other necessary supervision and inspection tasks. Article 19 Safety supervision and inspection of military nuclear facilities may take the form of reviewing relevant documents and records, on-site witnessing, symposium visits, verification inspections and measurements, etc. Article 20 The Commission of Science, Technology and Industry for National Defense shall organize appropriate personnel (inviting experts when necessary) to perform designated supervision and inspection tasks as needed. When supervisory and inspection personnel perform their tasks, they have the right to enter facilities and construction, operation or decommissioning sites related to supervision and inspection tasks with their valid certificates to investigate and collect safety-related information. Article 21 Personnel engaged in safety supervision and inspection of military nuclear facilities must perform supervision and inspection functions objectively and impartially, abide by supervision and inspection disciplines, keep state secrets, and shall not intervene in activities of a commercial nature related to the facilities being supervised and inspected and other activities that are detrimental to Supervise and inspect activities for effective completion of tasks. Article 22 The operating unit shall submit the progress of its safety-related activities and relevant documents and information to the Commission of Science, Technology and Industry for National Defense in accordance with regulations, and provide necessary conditions for supervision and inspection to ensure that the supervision and inspection tasks are implemented in a planned manner. Article 23 When the Commission of Science, Technology and Industry for National Defense confirms that it is necessary, it has the right to take compulsory actions and order operating units to take safety measures or stop activities that endanger safety.

Article 24 The operating unit has the right to refuse supervision and inspection requirements that are harmful to safety, but must implement the mandatory orders of the Commission of Science, Technology and Industry for National Defense. Chapter 5 Rewards and Punishments Article 25 The Commission of Science, Technology and Industry for National Defense shall commend units and individuals that have made outstanding achievements in ensuring the safety of military nuclear facilities. Article 26 Anyone who violates these regulations and commits any of the following acts shall, depending on the seriousness of the case, be given a warning, a fine, suspension of work or operation for rectification, or the punishment of revoking the safety license: (1) Without permission Or engage in the construction, operation, decommissioning of military nuclear facilities in violation of regulations, or change or transfer safety licenses without authorization; (2) Concealing or lying about relevant information or facts; (3) Refusing or obstructing safety supervision and inspection without reason; (4) No license or operating in safety-critical positions in violation of regulations; (5) Refusing to execute mandatory orders. Anyone who disobeys management, violates regulations, or forces others to work in violation of regulations, causing serious consequences and constituting a crime, shall be investigated for criminal responsibility by the judicial authorities in accordance with the law. Article 27 If safety supervision and inspection personnel of military nuclear facilities neglect their duties, engage in malpractice for personal gain, or abuse their power, they shall be given administrative sanctions depending on the severity of the case; if a crime is constituted, criminal liability shall be pursued in accordance with the law. Article 28 If the party concerned is dissatisfied with the administrative penalty, he may apply to the Commission for Administrative Reconsideration within 60 days from the date of receipt of the penalty notice, but the penalty of revoking the security license must be implemented immediately. Chapter Six Supplementary Provisions Article 29 Confidential matters involved in the safety supervision and management of military nuclear facilities shall be handled in accordance with national confidentiality laws and regulations and relevant provisions. Article 30 Operating units applying for military nuclear facility safety licenses shall pay the required safety review fees, and specific charging methods will be formulated separately. Article 31 The Commission of Science, Technology and Industry for National Defense is responsible for interpreting these regulations and formulating implementation details. Article 32 These regulations shall come into effect on the date of promulgation.
