The patent system is the product of the market economy and serves the market economy. To improve the level and ability of patent protection of state-owned enterprises and institutions in China, the most fundamental thing is to establish a perfect socialist market economic system, so that enterprises can truly become independent legal persons who are responsible for their own profits and losses and operate independently, and become market players. Only in this way can patent protection become the internal demand of enterprises themselves. At present, in the process of China's transition from planned economy to socialist market economy, the following countermeasures and measures should be taken to greatly improve the level and ability of patent protection of state-owned enterprises and institutions in the shortest time to adapt to the situation after China's accession to the World Trade Organization.
(1) Change the evaluation system of scientific and technological achievements as soon as possible and formulate policies and measures conducive to promoting patent protection. At present, the state's management and encouragement measures for scientific and technological achievements still focus on encouraging technological inventions in many aspects, rather than commercialization and industrialization of inventions. In recent years, the CPC Central Committee and the State Council have issued a series of important measures and policies to encourage high-tech industrialization and strengthen technological innovation. However, in the specific implementation process, some supporting measures are still not perfect. Only by taking patents as an important index to evaluate the input and output of science and technology and conscientiously implementing the patent reward mechanism in practice can we truly integrate with the international community and truly promote the industrialization of technological inventions.
(2) Governments at all levels should formulate practical measures to guide and promote state-owned enterprises and institutions to formulate internal intellectual property management systems, so that the intellectual property protection and management of enterprises and institutions can be institutionalized and standardized, so that all technologies that can obtain intellectual property protection such as patents can obtain patent protection at home and abroad in time, form a competitive advantage in the market, and minimize the losses caused by inadequate and untimely patent protection in the process of high-tech transformation.
(3) Pay full attention to the dissemination and application of patent information, pay full attention to the retrieval of patent information in the process of scientific research, avoid repeated research, and improve the starting point and level of research; Pay attention to the retrieval of patent information in the process of technology import and export to avoid being cheated and infringing patent rights; In the process of formulating scientific and technological development policies of enterprises, industries and countries, we should pay attention to the research and analysis of patent information in order to formulate correct scientific and technological policies.
(4) The state, local governments, enterprises and institutions should set up patent application funds and development and implementation funds for major technology projects, and give financial support and support to some high-tech projects that are related to the vital interests of the country, especially those with good prospects in foreign markets.
(5) Strengthen the publicity and patent protection of patents and other intellectual property rights, vigorously raise the awareness of intellectual property protection of the whole society, especially leading comrades in science and technology, economy and trade, and governments at all levels, increase the intensity of patent protection and administrative punishment, and effectively protect patentees.
