Legal analysis: the patent exclusive license can no longer be authorized. Without the permission of the patentee, once the transferee implements the patent, it belongs to patent infringement, and the transferor shall bear the tort liability. According to the different licensing scope, patent licensing contracts can be divided into exclusive licensing contracts, exclusive licensing contracts and general licensing contracts.
Legal basis: Article 12 of the Patent Law of People's Republic of China (PRC), where any unit or individual exploits another person's patent, it shall conclude an exploitation license contract with the patentee and pay the patentee the exploitation fee. The licensee has no right to allow any unit or individual other than those stipulated in the contract to exploit the patent.
