Can an unincorporated unit become a patentee?
Theoretically, an unincorporated branch has no independent legal personality, and its profits and losses, rights and responsibilities are borne by the head office. There is no independent qualification in law, and there is no qualification to apply for a patent. The Patent Examination Guide stipulates that in the examination procedure of the patent office, the examiner generally does not examine the qualifications of the applicant filled in the request.
