China National Intellectual Property Administration uses the third-party payment platform (UnionPay online payment) to provide users with electronic applications for inquiring the fees payable, filling in the payment list, generating orders and completing the actual payment.

(B) the scope of application of online payment system

1、? Applicable people

Registered users of electronic patent applications in China can use the online payment system to pay patent fees.

2、? Applicable payment methods

(1) individual users

Individual users can pay by bank card as long as they have a bank card with "UnionPay" logo and online payment function in the corresponding bank.

(2) institutional users

At present, there are 17 banks supporting corporate account payment, namely: China Industrial and Commercial Bank, China Agricultural Bank, China Bank, China Construction Bank, Bank of Communications, China CITIC Bank, China Everbright Bank, Huaxia Bank, China Minsheng Bank, Ping An Bank (formerly SDB), China Merchants Bank, Industrial Bank, Shanghai Pudong Development Bank, Hebei Bank and Huizhou Bank. (The actual supporting bank is subject to the display of UnionPay online payment platform)

3、? Applicable expense types

At present, the online payment system can pay two kinds of fees: the fee for ordinary national applications and the fee paid by PCT international application number when PCT first enters the national phase.

The fees for ordinary national applications include application fee, application surcharge, publication and printing fee, priority claim fee, substantive examination fee, reexamination fee, patent registration fee, publication and printing fee, annual fee, request fee for restoring rights, request fee for extending time limit, request fee for changing description items, request fee for patent evaluation report and request fee for invalidation.

The fees paid by PCT for entering the national phase for the first time with its international application number include application fee, application surcharge, publication and printing fee, priority requirement fee, substantive examination fee for invention patent application, grace fee, translation error correction fee and singularity recovery fee. After the PCT application enters the national phase, the fees paid by the national application number are regarded as the fees for ordinary national applications.

4、? Applicable payment time

(1) bank card payment

Bank card payment supports all bank card 7*24 hours payment services.

(2) Payment to company account

At present, among the banks that support corporate account payment, all other banks support 7*24 hours payment service except China Bank, which only supports 5*8 hours payment service. (The time for paying the bank service fee from the enterprise account shall be subject to the bank announcement. )

(3) Preparations for using the online payment system

1、? System preparation

(1) browser

The recommended browser version of online payment system is IE7.0.

You should turn off the browser's pop-up blocker before using it, otherwise you can't connect to the UnionPay payment page after generating the order.

(2)Excel version

Please use Excel version for online payment template file, that is, Excel2003 version.

2、? Bank card or account preparation

(1) bank card

Open the online payment function of bank card.

Two, the legal effect of using the online payment system for patent fees to pay patent fees

Article 94 of the Detailed Rules for the Implementation of the Patent Law of People's Republic of China (PRC) stipulates that all fees stipulated in the Patent Law and these Detailed Rules can be paid directly to the patent administration department in the State Council, remitted by post office or bank, or paid in other ways stipulated by the patent administration department in the State Council. As the patent administrative department of the State Council, China National Intellectual Property Administration's AnnouncementNo. 172, Notice on Patent Applicants and Patentees Paying Patent Fees, and AnnouncementNo. 180, Notice on Opening Online Payment Service for Public Accounts stipulate that online payment is a new way to pay patent fees. Online payment has the same legal effect as direct payment, post office remittance or bank remittance. The standards and requirements for paying patent fees are the same as the current payment methods.

Determination of payment date

The payment date of online payment is determined by the date corresponding to the actual payment time received by the online payment system from UnionPay online payment platform. Please pay full attention to the network situation, and try to use the online payment system to complete the payment of patent fees before 23: 30 every day, so as to avoid the sunset on the second day of the order generation day when the operation is around 0: 00, which will affect the normal payment of patent fees due to network reasons.

Three, the use of online payment system to pay the patent fee receipt.

(1) individual users

Individual users can obtain receipts through online payment in the same way as bank remittance and post office remittance. The online payment system provides a page for filling in the payee information. After the payer fills in the detailed address information of the recipient of the receipt, the Patent Office will send the receipt to this address by registered mail.

(ii) Institutional users

Receipts for online payment by institutional users can be obtained by mail or by self-collection. The mailing method is the same as that for individual users to receive the receipt, that is, the payer fills in the detailed address information of the recipient of the receipt in the online payment system, and the Patent Office sends the receipt to this address by registered mail; Self-service collection means that the payer chooses the self-service collection place in the online payment system and directly goes to the patent agency of China National Intellectual Property Administration Patent Office in the region to collect the receipt by himself.

Four, there are several ways to use the online payment system for patent fees to pay patent fees.

The online payment system for patent fees has four interfaces for filling in payment forms, which can also be called four payment portals: importing the national application payment form, importing the PCT application payment form for the first time in the national phase, paying the national application number, and paying the PCT application for the first time in the national phase.

5. Use the payment template for batch payment.

(1) Download and make payment template.

On the homepage of the electronic application website, click the "Tool Download" menu to enter the operation guide page for downloading the online payment system for patent fees. Find the online payment template file and click to enter the download page. This is a compressed file. Click File Download and save to your local computer. After downloading, unzip the compressed file and open the unzipped folder, and you can see two files: the domestic application number payment template and the PCT first payment template.

Double-click to open the domestic application number payment template or PCT to enter the payment template first. The contents to be filled in the domestic application number payment template form include the application number, the name of the payer, the name and amount of the fee; The contents that PCT needs to fill in when entering the payment template for the first time include application number, patent type, payer name, fee name and amount.

The second line of the payment template, that is, the line with serial number 0, does not need to be filled in. This line is mainly used to summarize the amount. Starting from the third line, directly enter the domestic application number or PCT international application number, and do not enter the serial number. The input of the application number should be complete and accurate. Note that the domestic application number does not need to enter a decimal point in the application number, and the PCT international application should also choose the patent type. The header of the patent fee receipt issued by China National Intellectual Property Administration Patent Office should enter the payer's name, which is not necessarily related to the actual payer, the person filling in the form, the electronic application registration user, etc.

Click the expense name drop-down box to select the expense type to be paid. If the application number does not meet the format requirements, the expense name drop-down box cannot be used.

The expense name drop-down box is used to filter the expense category according to the patent type corresponding to the application number. If the application number entered is the application number of a design, only various design fees will be displayed in the fee name. After selecting a specific expense name, if the selected expense name has a unique payment standard, such as "Design Application Fee", the standard amount of the expense name will automatically pop up in the amount column. If the expenses are delayed or only part of the expenses are paid, you need to manually modify the amount yourself. Click the amount cell, enter the number directly, and press enter; If the selected expense name has multiple payment standards, such as "Change Expense", the specific payment standard of the expense name will be displayed in the remarks column and 0 will be displayed in the amount column. You need to fill in the amount you want to pay. After this line is completed, the serial number will be automatically generated.

Each line in the template can only fill in one expense under one application number. If you want to pay multiple fees under the same application number, you need to fill in multiple lines, but the same application number can only correspond to the same payer's name.

After filling in all the fees to be paid, click Save to open the dialog box. After selecting the save location, select the format as ". Xls "and click Save.

(2) Import payment template

On the main page of online payment, select "Import Country Application Payment Doc" or "Import PCT Application Payment Doc for the First Time in China National Phase".

Click the drop-down box to select the template file, and click Import to import the template into the system. At this point, the system will check the contents of the template, including whether the filling format meets the requirements, whether the application number is accurate, and whether the corresponding relationship between the application number and the payer is unique. If the content in the template does not meet the relevant requirements, an error message box will pop up to prompt the specific error content. Click the "Back" button to modify the template according to the content prompted by the error message and import it again.

(3) Fill in the payer information.

After the template is successfully imported, the payment document information filled in the template will be displayed. Check the payment slip information with the completed template file, and fill in the payee information after it is correct. The recipient information can be selected from common recipients or directly filled in. When generating an order, the complete recipient information filled in by registered users will be automatically saved in the common recipient information, with a maximum of 10. You can manage frequently used recipient information in my address book. Select "Other Information" to fill in the recipient information yourself.

When filling in the recipient information, fill in the name of the recipient in the column of the receipt, that is, the recipient who wants the receipt issued by China National Intellectual Property Administration Patent Office to arrive. "Receiving province/municipality" and "Receiving city/district/county" are both selected from the drop-down boxes. "Receipt recipient address" directly fill in the specific street address, province, city and county information does not need to be filled in repeatedly. Recipient's Postal Code: Fill in the 6-digit postal code. The recipient's phone number can be filled in with the recipient's mobile phone number or fixed phone number. When filling in the fixed telephone, please note that the area code is separated from the specific telephone number by a small bar.

The payment method is "bank card payment" or "company account payment". If you choose to pay for the public account, you should also choose the way of mailing or obtaining the receipt yourself. By mail, China National Intellectual Property Administration Patent Office sends the patent fee receipt to the payer by registered mail; You have to choose the place to receive the receipt, and the payer directly goes to the patent agencies around the country to receive the receipt of the patent fee by himself.

(4) generate orders and pay fees

1. After filling in the recipient information, click "Generate Order", and a prompt box will pop up "The payment of this order must be completed before 24: 00 on the same day, otherwise the payable fee may change, resulting in payment errors".

Click OK to display the details of the order. The page records the payment order number, UnionPay transaction number and payer information of the order, including registered user information, address information of the order recipient, order generation time and payment details contained in the payment order. Payment number can be provided when inquiring in China National Intellectual Property Administration Patent Office, and UnionPay transaction number can be provided when using the transaction inquiry function and inquiring in the 24-hour customer service hotline of UnionPay.

2. Click "confirm payment", and the prompt box "A payment slip can only be paid once. Are you sure to pay now? ”。 Click OK, and a prompt box will pop up on this page to confirm the payment result. Please do not close this prompt box until the payment is completed. At the same time, according to the different settings of IE browser, the online payment page of UnionPay opens in another tab or another pop-up window.

Click to switch to the UnionPay online payment page (bank card payment) or the main page of enterprise payment platform (enterprise account payment).

There is a 24-hour customer service telephone number 955 16 on the upper right of the online payment page of unionpay. If you have any problems after connecting to the UnionPay page, including being unable to connect to the bank page and having questions about the payment result, you can call the customer service phone of UnionPay for consultation and inquiry. After selecting a bank, click "online bank payment" to enter the payment page of the bank. Fill in the card number, password, check code and other information on the payment page of the bank, and then complete the actual payment. Each bank has different pages and filling requirements. Please contact the issuing bank directly if you have any questions. Banks without icons can directly enter their card numbers, click "Online Banking Payment", and the system will automatically judge the corresponding banks and jump to the corresponding bank pages according to the entered bank card numbers.

The main page of the enterprise payment platform lists the amount of patent fees and handling fees paid. Click the bank icon below to select a bank. You can call the customer service phone at the bottom of the page at 4008809888-8 to inquire about the bank's online banking settings and handling fees. Select a bank and click OK to pop up a prompt box. Display: payment serial number, order type, payment bank, order amount, handling fee and total payment information, please confirm again. Click "Pay in Bank" to jump to the corresponding bank page and complete the payment according to the requirements of each bank.

After the payment is completed, return to the online payment page to confirm the payment result. According to the actual payment status, if the payment is successful, clicking the "Payment Complete" page will display the order status and payment date; If the payment fails, click "Payment Encountered Problems". After the payment fails, you can use my order query to regenerate the order and make payment by using the function of copying the order. If you choose to pay later when paying, the order status will be "Pending Payment", or you can query payment through "My Order". See "VII. 6. Use the webpage to fill in online payment.

Select "Pay by national application number" or "Pay by international application number when PCT international application enters the national phase for the first time" on the main page of online payment.

(1) Fill in payment information

Enter the complete and accurate national application number or PCT international application number, and the national application number does not need decimal point.

Enter the name of the payer. The payer's name should be entered together with the title of the patent fee receipt issued by China National Intellectual Property Administration Patent Office, which is not necessarily related to the actual payer and the electronic application registration user.

Click the "Query" button, and the invention name and payable fee of the application number will be displayed at the bottom left of the page. Expenses payable lists the standard amount of all expenses payable under the application number minus the actual amount of unused expenses.

All expenses payable will be selected by default. If you only want to select some expenses, you can use the check boxes in front of the expense details to select them. Optional fees are in the lower right corner of the page. Click the drop-down box of optional expenses and select the type of expenses to be paid. For each option, a record will be added to the list of optional payments. In the payment amount input box, enter the specific payment amount to be modified.

After selecting the fee, click "Add" to return to the blank current page, and you can continue to enter other application numbers for related operations. It is suggested that the application number in the same order should not exceed 10. After adding all the application numbers to be paid, click the "Confirm" button to enter the page of filling in payer information.

Confirm the completed billing information again. After selecting specific expense data, click Delete to delete the selected expense data, and click Modify to return to the previous page for modification.

The recipient information can be selected from common recipients or directly filled in. When generating an order, the complete recipient information filled in by registered users will be automatically saved in the common recipient information, with a maximum of 10. (A) order management

On the main page of online payment, select "My Order" to enter the order query page, and filter by payment order number, order status and order creation time. Click "Query" to display the order list. Select a specific order and click View to view the order information.

Select the order generated today, and the order status is "Payment Failed". Click the Copy Order button to copy the order.

Click "Regenerate Order" to generate a new payment order number and UnionPay transaction number. The status of the newly generated order is Pending Payment.

(2) Address book management

On the main page of online payment, select "My Address Book" to enter the common address information management page.

Enter the recipient's name, address, postal code and phone number, and then click Add to add the address information to the address information of common recipients.

Click "Edit" and "Delete" in the upper right corner of "Manage Common Information" to manage the existing address information. The system supports the management and maintenance of 10 common addresses at most.

(3) Transaction inquiry

On the main page of online payment, select "Transaction Inquiry" to enter the transaction inquiry page.

Support the transaction inquiry function of bank card orders and company orders. Click the corresponding order query, enter the UnionPay transaction number and click "Query" to query the order transaction results of different order payment status in the system in real time.
