Classification of patent strategy

As the lifeline and amulet of enterprise development, patent strategy has many effective forms, but the most important one can be divided into offensive strategy and defensive strategy.

1, patent attack strategy

Patent attack strategy refers to the strategy of actively, actively and timely applying for patents and obtaining patent rights, which enables enterprises to take the initiative in the fierce market competition and win greater economic benefits for enterprises. Patent attack strategy mainly includes the following contents:

(1) basic patent strategy, accurately predict the future development direction of technology, and take core technology or basic research as the basic direction.

(2) Peripheral patent strategy, that is, the strategy of adopting many different patents with the same principle and surrounding other people's basic patents to strengthen confrontation with basic patentees. Or when one's basic patent is attacked, weave a patent net around the basic patent and take the method of layer-by-layer containment to confront it.

(3) Patent transfer strategy, that is, among the patents obtained in many technical fields, actively transfer the unimplemented patent technology to other enterprises.

(4) patent purchase strategy, that is, the strategy of buying all competitors' patents to monopolize the market.

(5) the strategy of combining patents with products, that is, the strategy of imposing one's own products on the other side while licensing others to use the patents of the enterprise, in order to improve one's position in the market competition.

(6) the strategy of combining patents and trademarks, that is, the strategy of exchanging the right to use patents and trademarks.

(7) Patent application strategy for capital, technology and products export, that is, the strategy of applying for patents in importing countries before capital, technology and products export to protect the exclusive rights of capital, technology and products.

(8) Patent backflow strategy, that is, the strategy of digesting, absorbing and innovating imported patents, forming new patents, and then transferring them to the original patent export enterprises.

2. Patent defense strategy

Patent defense strategy refers to a strategy to protect enterprises and reduce losses to a minimum by defending against patent attacks from other enterprises or resisting patent obstruction from other enterprises. Patent defense strategy mainly includes the following contents:

(1) revocation strategy, that is, aiming at the loopholes and defects of the patent of the other party, the patent obtained by the other party cannot be established or invalid by using procedures such as revocation and invalidation.

(2) Open strategy, that is, if this enterprise doesn't need to obtain a patent, but if it is preempted by other enterprises, it is not conducive to this enterprise. It is a strategy to disclose the technical content first and prevent other enterprises from obtaining a patent.

(3) Cross-licensing strategy, that is, the strategy of implementing each other's patents between enterprises in order to prevent infringement.
