Article 78 of the Detailed Rules for the Implementation of the Patent Law stipulates that the departments for the administration of patent work mentioned in the Patent Law and these Detailed Rules refer to the departments for the administration of patent work established by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government and the people's governments of cities divided into districts with heavy workload in patent management and strong practical handling capacity.
Article 2 of the Measures for the Administrative Enforcement of Patents stipulates that these Measures shall be applicable to the administrative enforcement of patents by the departments in charge of patent work, that is, handling patent infringement disputes, mediating patent disputes and investigating and dealing with patent counterfeiting.
