In the judgment of novelty, the subordinate concept affects the novelty of the superordinate concept, that is, the concrete one affects the abstract one, but not vice versa.

Don’t confuse novelty and infringement determination. If it is an infringement determination, 58 and 75 must be in the range of 40-100.

For the second example, 95 is a subordinate concept, and 70-105 is a superordinate concept. The superordinate concept does not affect the novelty of the subordinate concept; similarly, for infringement determination, 95 falls within the range of 70-105.
