Customs protection modes of intellectual property rights can be divided into active protection and passive protection.
1, active protection mode
If the customs discovers that the suspected infringing goods are about to enter or leave the country, it will stop releasing them and notify the intellectual property rights holders who have filed with the General Administration of Customs.
If the obligee or his agent applies for customs protection and provides guarantee within 3 working days from the date of service of the notice, the customs will detain the goods suspected of infringement, otherwise the goods will be released.
2. Passive protection mode
Where the intellectual property right holder finds that the goods suspected of infringing intellectual property rights are about to be imported or exported, he may provide corresponding information and guarantee to the customs and apply for protective measures.
After the customs impounds the goods suspected of infringement according to the application, the intellectual property right holder may apply to the court to take measures to order the infringement to stop or preserve the property. Within 20 working days from the date when the customs detains the suspected infringing goods, the customs shall provide assistance if it receives a notice from the people's court for assistance in execution. The customs will release the goods without receiving the notice.
