Development and Reform Commission: Newly-built independent pure electric vehicle projects should have invention patents.

Recently, the National Development and Reform Commission (NDRC) has publicly solicited opinions from the society on the Provisions on Investment Management in Automobile Industry (draft for comments). It is clearly stipulated in the exposure draft that an enterprise as a legal person should own the invention patent of the core technology of pure electric vehicle, and obtain authorization or confirmation when applying for the investment project of a new independent pure electric vehicle enterprise; After the investment projects of newly-built independent pure electric vehicle enterprises are completed and put into production, only pure electric vehicle products with independent registered trademarks and brands shall be produced. It is understood that in order to improve the investment management of the automobile industry, promote the healthy and orderly development of new energy vehicles, focus on building an innovative development system for smart cars, and promote the high-quality development of the automobile industry, the National Development and Reform Commission has drafted a draft for comments. The public consultation ended on August 4, 20 18. Relevant units and people from all walks of life can log on to the portal of the National Development and Reform Commission to give their opinions on the draft. According to the exposure draft, when an enterprise as a legal person applies for the construction of an independent pure electric vehicle enterprise investment project, shareholders should have the intellectual property rights and production capacity of key components such as vehicle control system, drive motor and vehicle power battery, and should have the invention patent of the core technology of pure electric vehicle and be authorized or confirmed; Pure electric vehicle products that need to be developed and have intellectual property rights if other market entities such as design and development enterprises and overseas enterprises are major shareholders; After the newly-built independent pure electric vehicle enterprise investment project is completed and put into production, only pure electric vehicle products with independent registered trademarks and brands will be produced.
