How to change the name of the patent applicant (patent right)?

The change of the name of the applicant (patent) refers to the change of the name of the applicant (patent) when the applicant (patent) is a natural person; If the applicant (patentee) is a unit, its name shall be changed. When the applicant goes through the formalities of changing the applicant's name (patent right), it shall submit a statement of description change, pay the description change fee (that is, description change fee) in accordance with the regulations, and click to view the charging standard for patent description change. The handling fee for changing the recorded items shall be paid within one month from the date of making the request. If a patent agency is not entrusted, the procedures for changing the description items shall be handled by the applicant (patentee) or his representative; If a patent agency has been entrusted, it shall be handled by the patent agency.

In addition to submitting a statement on the change of specification items, the applicant (patentee) shall also provide the following documents to prove the change of specification items as appropriate:

(1) If an individual requests to change his/her name, he/she shall submit a certificate issued by the household registration management department.

(2) If an individual requests a change due to an error in filling in, he/she shall submit his/her signed or sealed statement and identification.

(3) If an enterprise as a legal person requests to change its name, it shall submit the certification documents issued by the administrative department for industry and commerce.

(4) If a public institution or social organization requests to change its name, it shall submit the certification documents issued by the registration administration department.

(five) if the legal person organ requests to change its name, it shall submit the certificate of the superior competent department.

(6) If any other organization requests to change its name, it shall submit the certification documents issued by the registration administration department.

(7) If a foreigner, foreign enterprise or other foreign organization requests to change its name, it shall submit corresponding supporting documents with reference to the above provisions.

(8) If a foreigner, foreign enterprise or other foreign organization requests to change the Chinese translation, it shall submit the applicant's declaration (patent right). The application number (or patent number), the name of the invention-creation, and the name of the applicant (or patentee) shall be indicated in all kinds of supporting documents submitted. All kinds of supporting documents should be original. If the certification document is a copy, it shall be notarized by the competent department that issued the certification document or stamped with the official seal; The certification documents formed abroad are photocopies, which should be notarized and authenticated.

The examiner shall conduct the examination according to the statement on the change of specifications and the attached supporting documents submitted by the parties. If the reporting procedures for filing project changes are not in conformity with the provisions, a notice shall be issued to the parties who have gone through the formalities for change; If the reporting procedures for the change of the recorded project meet the requirements, a Notice of Conformity shall be issued to the relevant parties, informing them of the situation that should be announced before and after the change of the recorded project, and at the same time informing them of the issue number to be announced. The change procedure of recorded items shall take effect as of the date when the Patent Office issues the notice of qualified change procedure.
