Definition of promised sales

It should be noted that the promised sale stipulated in China's patent law does not include the following two situations: First, it does not include the act of promising to provide patented methods. Only promised products, that is, patented products or products directly obtained according to patented methods, belong to promised sales. Second, it does not include the act of promising to sell indirect infringing products. That is to say, what is provided is not the patented product or the product itself directly obtained according to the patented method, but the key equipment, key parts and other products necessary for manufacturing these products, which belongs to the act of helping the infringement and providing the necessary conditions for the infringement. In fact, not only in the sales commitment, but also in China's patent law, indirect infringement in manufacturing and sales is not explicitly prohibited. The above two points are no different from TRIPS. However, it is inevitable to protect the rights of patentees more comprehensively and fully.
