Trade names have exclusive rights, but generic names do not.
the name of the drug is printed on the package of the drug. Drug names are divided into generic names and trade names. The generic name is the unified name stipulated by the state, and the generic name of the same drug must be the same. The trade name is the name given by different pharmaceutical companies to their own preparation products, and after registration, they have exclusive rights. Therefore, the preparation products of the same drug produced by different pharmaceutical factories often have different trade names.
The Measures for the Administration of Drug Registration stipulates that, except for new chemicals, new biological products and drugs with compound patents, other drugs (including raw materials, traditional Chinese medicines and generic drugs) are not allowed to use trade names, such as "Liuwei Dihuang Pill", a Chinese patent medicine. No matter how many manufacturers are producing it, each manufacturer can only use this name and no other names are allowed.
a certain drug of an enterprise is allowed to use the trade name, no matter how many dosage forms and specifications it has, it can only use the same trade name.
