In the patent infringement dispute with Geely, WM Motor won the first lawsuit.
In October 2018 and August 2019, Geely sued WM Motor with different entities. Recently, Yiou Automobile learned that the plaintiff, Chengdu Gaoyuan Automobile Industry, had withdrawn the case filed in 2018 and received approval from the Sichuan Provincial High Court in January 2020.
On February 12, relevant personnel of WM Motor told Yiou Automobile that the above news was true. At the same time, he said: "Weima has never infringed on the intellectual property rights of others at any time or in any field. Weima always adheres to forward research and development, independent development, and pays attention to the protection of intellectual property rights."
On January 12, 2020, the Sichuan Provincial Higher People's Court issued the "First-instance Civil Ruling on the Dispute between Chengdu Gaoyuan Automobile Industry Co., Ltd., WM Zhongde Automotive Technology Chengdu Co., Ltd., and Xiang Jianming's Infringement of Trade Secrets" on the China Judgment Documents Network. Plaintiff Chengdu Gaoyuan Automobile Industry Co., Ltd. and defendants WM Zhongde Automotive Technology Chengdu Co., Ltd., Xiang Jianming, Zhong Xingyuan, Kou Xinchen, WM Automotive Technology Group Co., Ltd., WM This court filed a case involving a dispute over trade secret infringement by Smart Travel Technology (Shanghai) Co., Ltd. on October 12, 2018. The plaintiff, Chengdu Gaoyuan Automobile Industry Co., Ltd., filed an application with this court to withdraw the lawsuit on December 25, 2019.
This court believes that the plaintiff Chengdu Gaoyuan Automobile Industry Co., Ltd. voluntarily withdraws the lawsuit and does not violate legal provisions, and this court allows it.
In accordance with the provisions of Article 145, Paragraph 1, of the Civil Procedure Law of the People's Republic of China, the ruling is as follows: Chengdu Gaoyuan Automobile Industry Co., Ltd. is allowed to withdraw the lawsuit. The case acceptance fee is 1,391,800 yuan, half of which is 695,900 yuan, which will be borne by Chengdu Gaoyuan Automobile Industry Co., Ltd.
The plaintiff, Chengdu Gaoyuan Automobile Industry Co., Ltd., is a first-level manufacturing subsidiary of Zhejiang Geely Holding Group Co., Ltd. and is mainly responsible for the R&D and production of the SUV model Geely Vision SUV (Global Hawk GX7). It is reported that Geely believes that part of the design of the WM EX5 has copied the Geely Vision SUV model, but WM insists that it is all independently developed.
The above-mentioned lawsuit, which has been withdrawn by Geely, is only part of the patent litigation between Geely and WM Motor.
On August 30, 2019, Zhejiang Geely Holding Group and Geely Automobile Research Institute once again filed a lawsuit with the National High Court in the name of infringement of trade secrets. The defendants were WM Motor and its four subsidiaries. Company - WM Automotive Technology Group, WM Smart Travel Technology, WM Motor Manufacturing Wenzhou Company, WM New Energy Vehicle Sales Company. The claim amount this time is as high as 2.1 billion yuan, which has attracted attention from all walks of life.
The dispute in this case was officially opened in the Shanghai High Court on September 17, 2019. Since the case was finally heard in private, non-relevant persons could not observe it, and the complaint was not made public. Therefore, it is difficult for outsiders to obtain specific information about the case.
Currently, the patent litigation case between Geely and WM Motor is still ongoing. Some experts said that the biggest difficulty in this lawsuit is the production of evidence. It is expected that the trial of the case will not end in a short time unless the two parties reach a settlement out of court.
