How to reply to the Notice of Patent Examination Opinions?

In the process of preliminary examination or substantive examination, the examiner finds that there are obvious defects, format defects or substantive defects in the application, and will notify the applicant to modify and correct the application within the specified time in the form of a notice of correction or a notice of examination opinions, or state opinions on the defects pointed out by the examiner. The applicant must respond to this. If the applicant fails to reply within the time limit without justifiable reasons, the application will be deemed to have been withdrawn. Therefore, when answering the questions raised in the Notice of Review Opinions, we should pay attention to the following aspects:

(1) Observe the reply deadline. The agent should pay attention to the time limit specified by the examiner in the notice, and calculate the reply time limit based on the date issued by the examination and approval authority in the upper right corner of the notice. If the agent (applicant) cannot reply within the prescribed time limit, it shall request an extension of the time limit before the expiration of the time limit, and submit a request for extension of the time limit in duplicate.

(2) Respond to all the contents of the notice one by one. Failure to reply to the examination opinions can be regarded as failure to reply on time, resulting in the application being deemed to be withdrawn. The reply can agree with the examiner's opinion, and make corrections or amendments to the application according to the examination opinions; You can also disagree with the examiner and state the applicant's opinions and reasons.

(3) The reply shall be in the form of an opinion statement uniformly formulated by the examination and approval authority. In addition to the addition, deletion or modification of individual words, it can be directly explained in the opinion statement; If there are many modifications, a replacement page in the prescribed format shall be submitted, except for the opinion statement.

(4) The modification of the application documents can't go beyond the scope recorded in the original specification, otherwise the application will be rejected.
