When can a divisional application be filed during the patent application process?

According to the provisions of my country's "Patent Examination Guidelines", the applicant shall have 2 months at the latest from the date of receipt of the State Intellectual Property Office's notice of granting patent rights on the original application (i.e. the registration formalities Submit a divisional application before the expiry of the time limit).

After the original application has paid the registration fee, it can still file a divisional application within the time limit specified above. In addition, a divisional application can be filed before the original application has been rejected (including within 3 months from the date the applicant receives the rejection decision, during the review period and during the administrative litigation); before the original application has been withdrawn, the original application has been deemed A divisional application may also be filed before the withdrawal (including the recovery period).

It should be noted that the submission time of the applicant's resubmission of the divisional application for the already filed divisional case will be reviewed based on the original application. However, due to the single defect in the divisional application, the applicant will resubmit the application in accordance with the examiner's opinions. Exceptions are made when a divisional application is filed.
