Chapter I General Provisions Article 1 In order to improve the ability of independent innovation, promote the transformation of scientific research and technological innovation achievements into real productive forces, and promote economic and social development, these Regulations are formulated in accordance with the Law of People's Republic of China (PRC) on the Progress of Science and Technology and other relevant laws and regulations, combined with the actual situation of this province. Article 2 These Regulations shall apply to independent innovation promotion activities such as research and development, achievement creation, achievement transformation and industrialization, innovative talent team building and innovation environment optimization within the administrative area of this province. The term "independent innovation" as mentioned in these Regulations refers to the activities of citizens, legal persons or other organizations to form independent intellectual property rights or proprietary technologies through scientific research and technological innovation, and to provide new products, new processes and new services to the market in various ways. Article 3 The people's governments of provinces, cities and counties (including county-level cities and districts, the same below) shall lead the work of independent innovation within their respective administrative areas. The administrative departments of science and technology of the people's governments of provinces, cities and counties shall be responsible for the macro management, organization and coordination of promoting independent innovation within their respective administrative areas. Development and reform, economy and informatization, human resources and social security, finance, education, agriculture, taxation, intellectual property and other relevant departments are responsible for promoting independent innovation within their respective functions and duties. Article 4 To promote independent innovation, we should adhere to the principles of taking enterprises as the main body, taking the market as the guidance, combining Industry-University-Research, guiding and supporting the government, and participating the whole society. Article 5 Promoting independent innovation is the common responsibility of the whole society. Relevant government departments, news media and other social organizations should promote the formation of a public opinion atmosphere and social fashion that advocates science, respects talents, respects creation, dares to innovate and tolerates failure. Chapter II Innovation Platforms Article 6 The people's governments of provinces, cities and counties shall formulate measures to guide innovation elements to gather in enterprises, improve the ability of original innovation, integrated innovation, introduction, digestion, absorption and re-innovation, improve the market-oriented mechanism of technological innovation, improve the industrial technology innovation chain, improve the core technology development ability of enterprises, and promote enterprises to become the main body of innovation decision-making, R&D investment, scientific research organization and achievement transformation. Seventh encourage enterprises to focus on improving core competitiveness and long-term development, and increase investment in technology research and development. The research and development expenses of high-tech enterprises and innovative enterprises shall not be lower than the proportion stipulated in the national standards for the identification of high-tech enterprises; The annual investment in research and development of large and medium-sized enterprises and innovative small and medium-sized enterprises shall not be lower than the national and provincial standards. State-owned enterprises should gradually increase investment in scientific and technological research and development according to their profitability. Article 8 The provincial people's government shall formulate policies to promote the development of marine science and technology, develop core technologies of marine industry, support the innovation of core technologies of marine industry, improve the transformation rate of marine scientific and technological achievements, and guide and encourage the development of marine scientific and technological enterprises. Article 9 Enterprises may independently set up or jointly set up various research and development institutions and technological innovation organizations with other enterprises, scientific research institutions and universities, independently or jointly carry out independent innovation activities such as tackling key core technologies, basic research and personnel training, and implement major national, provincial and municipal projects or research and develop major equipment and new products. Article 10 Support enterprises, scientific research institutions and institutions of higher learning to promote the research and development of national major technological innovation products and service standards, participate in the formulation of industry standards, national standards and international standards, and promote the formation of technical standards related to independent innovation achievements. Enterprises that play a leading role in the formulation of standards, or enterprises that have won the title of national famous and well-known brands, national patent gold awards and excellent awards, shall be rewarded in accordance with relevant regulations. Eleventh enterprises and institutions can carry out integrated innovation through technical cooperation, technology outsourcing, patent licensing, etc., carry out research and development of key industries, improve system integration and engineering conditions, and form products or emerging industries with market competitiveness. Article 12 Enterprises are encouraged to introduce advanced and applicable technologies that are conducive to enhancing their core competitiveness, merge with other scientific and technological enterprises, or set up R&D institutions inside and outside the province to carry out technical cooperation. The digestion and absorption of independent intellectual property rights or unique core technologies can be used as an important basis for the evaluation and acceptance of major technologies and equipment introduced by enterprises. The relevant departments of science and technology, development and reform, economy and informatization in the province shall, in accordance with the relevant policies of the state and the province, guide enterprises and institutions to introduce advanced technologies and equipment for digestion, absorption and re-innovation, restrict the introduction of technologies and equipment that already have research and development capabilities in China, and prohibit the introduction of technologies and equipment with high energy consumption, high pollution and backwardness. Thirteenth guide enterprises to adopt contract energy management, financial leasing of major technical equipment, e-commerce and other business models to enhance their operational capabilities; Support enterprises to use new technologies such as Internet and Internet of Things, optimize internal processes and integrate external resources, develop and apply information management technologies, reorganize industry consolidation, and promote the innovation of operation mode. Fourteenth encourage enterprises to carry out independent innovation in the fields of resources and environment, population health, cultural creativity, energy conservation and emission reduction, public safety, earthquake prevention and disaster reduction, urban construction and so on. Fifteenth provincial people's government according to the need to approve the establishment of high-tech industrial development zones, science parks, software parks and other innovation parks, improve the innovation park research and development, testing, incubators, technology and finance, basic databases and other innovation platforms. Promote innovation parks to use their own characteristics and advantages to develop high-tech industries, advanced manufacturing industries, modern service industries and strategic emerging industries. Establish characteristic industrial clusters, rely on the advantages of industrial clusters, develop innovative platforms such as R&D, testing and pilot testing, and use the advantages of leading industries to enhance the international competitiveness of enterprises. Accelerate the construction of carriers such as science and technology business incubators, university science parks and overseas students' pioneer parks, promote university science parks to become independent innovation bases, and provide services for the incubation of high-tech enterprises, the transformation of scientific and technological achievements in colleges and universities, and the cultivation of innovative and entrepreneurial talents.
