(1) The annual fee for the year in which the patent right is granted shall be paid at the same time as the registration formalities, and the annual fee for subsequent years shall be paid before the expiration of the previous year. The expiration date of the payment period is the corresponding date of the application date of the current year.
(2) If the patentee fails to pay the annual fee on time or the amount paid is insufficient after the year of granting the patent right, the patentee shall pay it within six months from the date of expiration of the annual fee at the latest, and at the same time pay a late fee. It should be noted that the deadline of (1) annual fee is related to the application date, not the authorization date; (2) The fee will be reduced for only three years after authorization, and paid in full at other times; (3) The annual fee paid for the first time after the invention patent is granted is the annual fee for the second year, the third year or the fourth year, and generally it cannot be the annual fee for the first year.
