Interim Provisions on Declassification and Classification of Controlled Use Scope of Archives Collected by National Archives at All Levels

Article 1: In order to correctly handle the relationship between keeping state secrets and opening archives, in accordance with the "Archives Law of the People's Republic of China" and the "Law of the People's Republic of China on Keeping State Secrets", we have formulated these regulations. Article 2 The declassification of files marked “top secret”, “confidential” and “secret” (hereinafter referred to as “confidential files”) that were created before January 1, 1991 and preserved by the national archives at all levels shall be carried out by National archives at all levels are responsible for this.

For confidential files that are about to be thirty years old, if the agency or unit that originally created the file considers that they are still state secrets, the records shall be filed within six months before the thirty-year anniversary of the date on which the files were created. Notify (in the form of a document, the same applies below) to the archives administrative agencies and the National Archives at the same level. If the extension of the confidentiality period is not notified within the time limit, the National Archives at all levels shall handle it in accordance with Article 7 of these regulations. Article 3 The declassification work of confidential archives that were created before January 1, 1991 and have not been entered into the archives shall be carried out by the agencies and units that created the archives. The cleanup work must be completed before being transferred to the national archives at all levels. Otherwise it will not be accepted. Article 4. Confidential-related files maintained by national archives at all levels and created after January 1, 1991 will be declassified on their own from the date of expiration of the confidentiality period if they have not received notification of the change of confidentiality period. Article 5 If the economic, scientific, technical, and cultural confidential archives preserved by the national archives at all levels are deemed necessary to be opened in advance according to needs, a notice requesting early declassification shall be issued to the original agency or unit that created the archives, and the relevant agencies and units shall A reply must be made within six months of receiving the notice. If no reply is given, the archives may handle the matter in accordance with relevant regulations. Article 6 If the agency or unit where the original files were formed is revoked or merged, the unit responsible for making decisions on the confidentiality level and confidentiality period of the confidential files formed shall be the responsibility of the unit responsible for its original functions; there is no corresponding responsible agency or unit are the responsibility of the relevant archives.

Article 7 The historical archives preserved by the national archives at all levels that were formed before the founding of the People's Republic of China, the declassified archives that were formed more than 30 years after the founding of the People's Republic of China and other archives with unclassified classification levels, The use of any content involving the following content should be controlled:

(1) It involves major issues of our party and the country, major political events that have not yet been concluded and should not be made public. Opening them to the public will affect intra-party unity, the party and the country. Archives of the normal work of state agencies;

(2) Political and historical evaluations and work and life involving party and government leaders at all levels and famous patriotic progressives from all walks of life that are not suitable for disclosure and are open to the public. Archives that damage personal image, personal dignity and reputation;

(3) Archives involving the organizational relationships, working methods, strategic means, and intelligence sources of our party and state’s secret work, opening them to the public will undermine the protection of the party and the country Archives in which the reliability of measures and means for national security and interests has been reduced or has become invalid;

(4) Files involving secret relationships between our party and country and their leaders and foreign political party organizations and their leaders, Archives that are open to society and will affect the normal relations between the two parties, the two countries, and other external relations;

(5) Files involving the destruction of our party’s underground organization by enemy agents during the Republic of China, which are purely fabricated in order to instigate rebellion. Archives that would damage the image of our party, country and its leaders when opening up the society;

(6) Archives involving sensitive issues and strategic deployments in territory and borders, national defense facilities, military locations, arms trade, military scientific research and Archives produced and open to society that are not conducive to safeguarding national sovereignty and territorial integrity, and endanger the country's strategic defense capabilities;

(7) Unofficially determined files involving ethnic disputes and ethnic contradictions in religion, united front, and overseas Chinese affairs Guidelines and policies, opening to society will affect national unity, social stability and be detrimental to national unification; (8) Involving boundary issues between domestic administrative regions, opening to society may trigger boundary issues Disputes, archives that affect social stability and people's unity;

(9) Archives that accurately record customs and sentiments, and may support enemy military or economic strategies, or damage the national image after being opened to society;

(10) Archives involving key technologies, technical know-how, traditional techniques, formulas, and important resources of our country’s science and technology, the opening of which would weaken our country’s economic and technological strength or cause losses to the national economy;

(11) In relation to internally controlled policies, strategies, and opinions and plans for handling specific incidents in scientific and technological exchanges, economic cooperation, trade exchanges, and foreign affairs with foreign countries, opening up to society will put our country at a disadvantage in external activities. Archives that are in a disadvantageous position or that cause political passiveness or economic losses;

(12) Archives involving the formation of foreign institutions in China, and opening to the public will cause archive ownership disputes;

(13) Archives involving copyrights, invention rights, and patent rights that would cause infringement lawsuits and harm national interests if opened to the public;

(14) Archives involving Chinese and foreign documents that still have legal effect Property rights, creditor's rights, and files that would cause foreign disputes and harm national interests if they were opened to the public;

(15) Investigation and specific investigations into relevant personnel's violations of disciplines and laws in judicial, supervisory, disciplinary inspection, and organizational personnel work According to the circumstances of the trial, the opening of the files to the public will cause adverse political effects or be detrimental to the personal safety of the trial personnel, whistleblowers, etc.

(16) Archives involving citizens’ privacy, which would harm the reputation and rights of citizens if opened to the public;

(17) Archives involving compatriots in Taiwan, Hong Kong and Macao and overseas Chinese Archives of patriotic progressives whose opening to the public would damage their reputation and rights and interests;

(18) Archives involving the military, police, constitutional and special organizations and personnel during the Republic of China, opening to the public for a certain period of time files that may have a negative impact on certain aspects;

(19) When agencies, units and individuals transfer, donate, or store files, they clearly indicate that they cannot be opened.

(20) In addition to the above scope, other files that affect the interests of the party and the country.
