The ninth answer skill of invention patent: out-of-range modification

If the notice of examination opinions points out that the applicant's modification of the application documents does not conform to the provisions of Article 33 of the Patent Law, that is, it is beyond the scope recorded in the original specification and claims, the applicant shall carefully analyze the examiner's opinions according to the provisions of Section 5.2 of Chapter 8 of Part II of the Patent Examination Guide to determine whether the modification is beyond the scope.

For the modification that can be directly derived from the contents recorded in the original application documents, it can be explained in detail in the opinion statement how to derive the currently modified contents from the contents recorded in the original specification and claims. In order to persuade the examiner better, you can meet with the examiner or discuss it by phone.

For the part that is really modified beyond the original application documents, it shall be deleted according to the requirements of the notice of examination opinions to overcome the defect that the modification is beyond the scope, otherwise the application will be rejected.
