I. Changes of inventors
(1) If the inventor requests to change the name, he shall submit the certificate issued by the household registration administration department.
(2) Where the inventor requests a change due to omission or wrong filling, it shall submit the certificate signed or sealed by all applicants (or patentees) and all inventors before the change.
(3) Where a change request is made due to a dispute over the qualification of an inventor, reference can be made to the contents of "How to Deal with the Transfer of the Right to Apply for a Patent (or Patent Right)".
(4) Where the Chinese translation is requested to be revised, the inventor's statement shall be submitted.
II. Changes of patent agencies and agents:
(1) If a patent agency changes its name or place, it shall go through the registration formalities with the competent department of China National Intellectual Property Administration first. After the registration change procedures come into effect, the Patent Office will uniformly change all valid patent applications and the patents they represent. The change of patent agent shall be handled by the patent agency.
(2) If the entrustment is dissolved or resigned, the other party shall be informed in advance.
When the entrustment is terminated, the applicant (or patentee) shall submit a declaration on the change of cataloguing items, a termination letter signed or sealed by all applicants (or patentees), or only a declaration on the change of cataloguing items signed or sealed by all applicants (or patentees).
When a patent agency resigns from the entrustment, it shall submit a statement of changing the description items, and attach a statement signed or sealed by the applicant (or patentee) or its representative agreeing to resign from the entrustment, or a statement sealed by the patent agency indicating that the applicant (or patentee) has been informed.
Before the alteration formalities come into effect (i.e. before the issuance of the Notice of Conformity), the original patent agency entrustment relationship is still valid, and all kinds of affairs handled by the patent agency for the applicant (or patentee) will continue to be valid after the alteration formalities come into effect. If the change procedures are not in conformity with the provisions, the examiner shall issue a notice to the parties who have gone through the change procedures, and it shall be deemed that the notice has not been submitted; If the change procedure conforms to the provisions, the examiner shall issue a notice of conformity to the procedure to the parties.
If the first applicant is a foreign applicant who has no habitual residence or business office in Chinese mainland, the applicant (or patentee) shall entrust a new patent agency at the same time when handling the cancellation or resignation procedures, otherwise the cancellation or resignation procedures will not be handled, and the examiner shall issue a notice deemed to have not been submitted.
The first applicant is an applicant from Hongkong, Macau or Taiwan Province who has no habitual residence or business office in Chinese mainland. The applicant (or patentee) shall entrust a new patent agency at the same time when going through the formalities of revocation or abandonment of entrustment, otherwise it shall not go through the formalities of revocation or abandonment, and the examiner shall issue a notice deemed as not submitted.
(3) Where the applicant (or patentee) changes the patent agency, it shall submit the revocation statement of the original patent agency and the power of attorney of the new patent agency signed or sealed by all the applicants (or patentees).
(4) If the patent application right (or patent right) is transferred, and the changed applicant (or patentee) entrusts a new patent agency, a power of attorney signed or sealed by all the changed applicants (or patentees) shall be submitted; If the changed applicant (or patentee) entrusts the original patent agency, it only needs to submit the power of attorney signed or sealed by the new applicant (or patentee).
