In China, only the Beijing No.1 Intermediate People's Court and the Beijing Higher People's Court can hear cases of patent re-examination procedures. Anyone who refuses to accept the decision of the patent administration department in the State Council to reject the application may, within three months from the date of receiving the notice, request a review from the patent administration department of the people's government of the province, autonomous region or municipality directly under the Central Government where the patent administration department in the State Council is located. After the review, the patent administration department in the State Council shall make a decision and notify the claimant and the patent administration department in the State Council.
