What is the procedure of patent reexamination and how to submit the patent reexamination fee?

According to Article 41 of the Patent Law, if the applicant refuses to accept the rejection decision, he may file a reexamination with the Patent Reexamination Board within three months from the date of receiving the notice.

In the first stage, pre-trial, the applicant has the opportunity to reply and modify when submitting for review. The defense documents shall be reviewed by the original examiner, and those that meet the requirements shall be authorized.

In the second stage, if the pre-trial fails, it will be reviewed by a three-member collegiate panel. The process is similar to ordinary review, and there may be many review opinions that need to be answered by the applicant.

If it passes the examination, it can be directly authorized or sent back to the original examiner for further examination;

If the collegial panel still fails to pass the examination, the rejection decision shall be upheld.

If the patent applicant refuses to accept the reexamination decision of the Patent Reexamination Board, he may bring a lawsuit to the people's court within three months from the date of receiving the notice.

Fees can be paid when submitted for review.
