Article 1 Data Ownership
1. In the process of foreign cooperative exploration of offshore oil resources, all data, records, vouchers and other original materials obtained for the execution of oil contracts shall Its ownership belongs to China National Offshore Oil Corporation (hereinafter referred to as the Chinese party).
2. The ownership of rock cores, rock samples, oil samples and other samples obtained by foreign contractors in the contract area belongs to the Chinese party.
3. During the validity period of the petroleum contract and after the contract is terminated (including after the contractor transfers its rights and obligations), except as otherwise provided in paragraphs 4 and 5 of Article 2 of these regulations, foreign contracts The data and samples mentioned in paragraphs 1 and 2 of this Article shall not be disclosed to third parties in any way; without the written consent of China, they shall not be transferred, donated, exchanged, sold or published in any way. Article 2 Management and Use of Information
1. During the implementation of petroleum operations, foreign contractors shall be responsible for properly handling the information and samples referred to in paragraphs 1 and 2 of Article 1 of these regulations. It shall be kept within the territory of China, provided to the Chinese side for use in a timely manner, and handed over to the Chinese side in phases and in batches.
2. Foreign contractors may use and copy the materials referred to in Paragraph 1 of Article 1 of these Regulations and the samples referred to in Paragraph 2 of Article 1 of these Regulations within China and outside China, and They are obliged to submit research, interpretation results, analysis and laboratory results to China in a timely manner. Foreign contractors shall not use the above-mentioned materials and samples for purposes unrelated to the execution of petroleum contracts.
3. When it is necessary to transport the original materials (such as original tapes, original records, etc.) referred to in Paragraph 1 of Article 1 of these Regulations and the samples referred to in Paragraph 2 of Article 1 to foreign countries for use, It is subject to the written consent of the Chinese party. Unless otherwise agreed by China, the rock cores and rock samples shipped abroad shall not exceed one-half of the sample quantity or volume; the original data shipped abroad shall be promptly shipped back to China for storage after being copied or used.
4. When foreign contractors need to provide information to third parties, such as banks and other credit institutions, contractors, consulting companies, and possible transferees of contract rights, in order to execute the oil contract, they must obtain the consent of the Chinese party , and at the same time, the foreign contractor should obtain a written guarantee from the above-mentioned third party that it will assume confidentiality obligations for the information provided.
5. Foreign contractors may provide required information to their superior companies and affiliated companies related to the execution of oil contracts, securities trading institutions, and their own governments, but they must report to the Chinese side in advance. Foreign contractors should notify the above-mentioned superior companies and affiliated companies that receive the information to assume confidentiality obligations for the information provided; notify the securities trading institutions and the contractor's home government to keep the information provided confidential in accordance with international practices.
6. Publication and provision of information to the press must be negotiated and agreed upon by both parties to the petroleum contract. Article 3 Exchange and provision of information in non-contract areas
1. Foreign contractors operating in the same offshore basin may exchange relevant information about the basin with the written consent of the Chinese party. Such exchanged information will still be subject to paragraph 3 of Article 1 of these Regulations.
2. If a foreign contractor needs relevant information, samples and other information owned by the Chinese party in other offshore basins or coastal lands of China in order to execute the contract, the foreign contractor may apply to the Chinese party, and the Chinese party will provide such information free of charge or as appropriate. Provided for a fee. Such information obtained by foreign contractors shall also be subject to paragraph 3 of Article 1 of these Regulations.
Article 4 Information that should be provided to the Chinese party
When carrying out petroleum operations, foreign contractors must provide the Chinese party with information including but not limited to the following:
1. Various overall plans and Individual work plan, design information and documents:
1. Overall and staged exploration planning for the contract area;
2. Annual exploration and construction plan;
3. Early development plan, overall development plan and development adjustment plan for oil (gas) fields;
4. Annual and individual geophysical exploration construction design;
5. Single well operation design for drilling and exploration well oil testing;
6. Production and trial production plans for oil (gas) fields (wells);
7. The content and overall progress plan of the project;
8. Basic design of engineering projects (such as jackets, decks, oil, gas, water treatment equipment, assemblies, pipelines, shipping, etc.);
9. Project implementation plan by year and month;
10. Engineering project procurement plan and progress;
11. Project trial operation and production progress.
2. Information and documents on the construction status of various operations:
1. Daily (weekly), monthly and annual reports on geophysical exploration operations;
2. Daily, monthly and annual reports on drilling and oil testing;
3. Daily, monthly and annual reports on test production and production of oil (gas) fields (wells);
4. Project construction monthly and annual reports;
5. Other work status reports;
6. Operating procedures and non-proprietary technical manuals for various types of petroleum operations.
3. Original data on various petroleum operations:
1. Original tapes, original records, data, seismic sections, maps and other relevant information of geophysical exploration operations;
2. Original records, data, maps and other relevant information of geochemical exploration operations;
3. Original records, data, drawings, samples and other relevant information of drilling, mud, logging, cementing, completion, oil testing, well workover and other operations;
4. Original records, data, drawings and other relevant information on test production, production, injection and production stimulation measures of oil (gas) fields (wells);
5. Original records, data and automatic recording cards for crude oil and natural gas measurement;
6. Original data and record cards for the transportation, storage, transportation and sales of crude oil and natural gas;
7. Various samples (including rock cores, cuttings, seabed subsoil, oil, gas, water, mud and other samples) and their analysis and test results;
8. Oil layer physical property data;
9. Sea state, hydrology and meteorological data.
4. Basic project information:
1. Engineering project design calculation instructions and detailed design drawings;
2. Design, manufacturing and installation technical specifications, safety specifications, environmental protection specifications and operating procedures;
3. Single project construction records and design and construction change orders;
4. Completion drawings, completion manuals and original records or reports of project quality acceptance.
5. Final results reports of various petroleum operations, various special studies and comprehensive research reports:
1. Reports on positioning results of geophysical exploration, geochemical exploration, drilling and other operations;
2. Geophysical exploration and geochemical exploration operation data processing and interpretation results report;
3. Submarine engineering geological survey results report;
4. Drilling geology summary report;
5. Oil test summary report;
6. Oil (gas) reservoir physical property research and simulation analysis report;
