Legal analysis: A patent certificate is a legal document issued by the Patent Office to the patent applicant after the patent application has passed the examination. The patent certificate records the name of the invention-creation, the name of the applicant for the invention-creation, the starting date of the patent right, the application number and the patent number. With a patent certificate, it proves that the patent belongs to you. If others want to use it, they must get your permission and pay you a fee. Otherwise, it is patent infringement, and the infringer can be prosecuted.
Legal basis: Article 3 of the Patent Law of People's Republic of China (PRC), the State Council Patent Administration Department is responsible for the management of patent work throughout the country; Accept and examine patent applications in a unified manner and grant patent rights according to law. The departments for patent administration under the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for patent administration within their respective administrative areas.
