What's the difference between bidding and negotiation?

First, the nature is different.

Competitive negotiation: Competitive negotiation procurement means that the purchaser and the government procurement agency negotiate with qualified suppliers on the procurement of goods, projects and services by forming a competitive advisory group (hereinafter referred to as the advisory group), and the suppliers submit corresponding documents and quotations according to the requirements of the consultation documents, and the purchaser determines the procurement method of the clinched supplier from the list of candidate suppliers put forward after the review of the advisory group.

2. Competitive negotiation: Competitive negotiation refers to a procurement method in which the purchaser or agency negotiates with a number of suppliers (not less than three) and finally determines the winning supplier.

Second, the scope of application is different

(1) Government purchases services;

(two) the technology is complex or special, and it is impossible to determine the detailed specifications or specific requirements;

(3) The total price cannot be calculated in advance because the time and quantity of art procurement, patents, proprietary technology or services cannot be determined in advance;

(four) scientific research projects with insufficient market competition and scientific and technological achievements transformation projects that need support;

(five) the bidding law and its implementing regulations stipulate that construction projects other than bidding must be carried out.

2. Competitive negotiation:

(1) Goods and services within the legally formulated centralized procurement catalogue that do not meet the standard of open tender amount;

(2) Goods and services that are beyond the legally formulated centralized procurement catalogue, purchase above the quota standard and fail to meet the standard of open tender amount;

(3) Goods and services that meet the standard of public bidding amount and are approved to adopt non-public bidding;

(four) government procurement projects other than construction projects that must be tendered according to the Bidding Law and its implementing regulations.

Third, the order of suppliers is different.

1. Competitive negotiation: In the detailed evaluation stage, the ranking of suppliers is determined according to the scores from high to low.

2. Competitive negotiation: In the detailed evaluation stage, the order of suppliers is determined according to the quotation from low to high.
