1. How to apply for a patent
1. The patent application process is as follows:
(1) Application, the applicant submits application materials in accordance with regulations;
(2) Acceptance and payment, the application shall be accepted to the State Intellectual Property Office, and the parties concerned shall pay the patent application fee;
(3) Preliminary examination, the State Intellectual Property Office shall conduct a preliminary examination after acceptance;
(4) Announcement in advance, announced immediately after preliminary examination;
(5) Substantive examination, the State Intellectual Property Office conducts substantive examination at the request of the applicant;

For inventions and creations that rely on genetic resources, the applicant shall state the direct source and original source of the genetic resource in the patent application document; if the applicant cannot explain the original source, the applicant shall state the reasons.
