Article 1: In order to strengthen the supervision and management of outdoor advertising in our city and improve the quality of outdoor advertising, in accordance with the "Advertising Law of the People's Republic of China" and the "Urban City Appearance and Environmental Sanitation Management Regulations" of the State Council and These measures are formulated in accordance with relevant national regulations and in combination with the actual situation of our city. Article 2 The outdoor advertisements mentioned in these Measures include:
(1) Advertisements published using roads, green spaces, squares, airports, stations, bridges, various venues (pavilions), buildings, structures and public facilities Advertisements;
(2) Advertisements published using means of transportation, floating objects on water, suspended objects in the air, and flying objects;
(3) Advertisements published outdoors in other forms. Article 3 The administrative department for industry and commerce is responsible for the qualification review of outdoor advertising business units, review of advertising content, registration before advertising is released, and supervision and inspection after advertising is released.
The urban construction management department is responsible for the planning, establishment and approval of outdoor advertising, and the daily coordination and management of outdoor advertising in terms of city appearance. Article 4 The following procedures shall be followed for publishing outdoor advertisements:
(1) Go to the urban construction management department to handle the establishment approval procedures with the site use agreement, design drawings, advertising color pictures and relevant materials.
(2) With the approval procedures set up by the urban construction management department and relevant supporting documents, go to the industrial and commercial administration department to handle the pre-release content review and registration approval procedures.
Outdoor advertising can be released only after approval. Article 5 If it is necessary to extend the release time or change the approval items after approval, the change procedures should be handled separately with the original approving authority.
If no advertisement is published within three months after approval, the original approval legal document shall be invalidated. Article 6 Outdoor advertising shall be subject to annual inspection. Article 7 The content of outdoor advertisements must be true and legal, and must not deceive or mislead the public. The characters, Chinese pinyin and units of measurement should comply with national regulations and should be written in standardized ways. Article 8 Outdoor advertisements must indicate the name of the production unit. The following advertisements should also be marked.
(1) Therapeutic drugs, marked with the approved name, declared brand name, and warnings such as “Purchase and use according to the doctor’s prescription”;
(2) Medical devices, marked with “Accurate Warnings such as "," "Medical Equipment Guangxuan" and "Use under the guidance of a doctor";
(3) Tobacco, with warnings such as "Smoking is harmful to health";
(4) For patented products, indicate the patent number and patent type;
(5) For alcoholic products below 39 degrees, indicate the alcohol content. Article 9 To hold sponsored cultural, sports, public welfare activities or to hold various commodity fairs, order fairs and other business activities, it is necessary to temporarily set up physical advertisements, banner advertisements, billboards, floating objects and other outdoor advertisements, and the sponsor must After obtaining the "Temporary Advertising Business License" issued by the municipal administrative department for industry and commerce, various approval procedures will be completed and set up in accordance with regulations. Article 10 Outdoor advertising facilities that have been set up with approval belong to the operator. Except for urban construction, road reconstruction and other national needs, which have the right to notify the operator to dismantle or relocate within the prescribed period, no unit or individual may occupy, dismantle or relocate at will. , covered or damaged. Article 11 The installation of outdoor advertisements shall not affect the view of the city or damage the appearance of the city; it shall not hinder traffic safety or damage green spaces and municipal public facilities.
The design and drawing of outdoor advertisements must be beautiful and novel. Advertising facilities must be sturdy and safe. Advertising business units should do a good job in daily maintenance of advertising media. When outdoor advertisements appear to be obsolete, missing or damaged, which impede the city's appearance and safety, the installation unit must repair them in a timely manner, and the time-limited rectification notice issued by the urban construction management department must be completed within the prescribed time limit. Article 12 When a printing unit undertakes the advertising and printing business of printed matter, it shall check the approval documents issued by the municipal administrative department for industry and commerce. No printing will be allowed without approval documents. Article 13 The urban construction management department shall, under the unified planning and guidance of the municipal government, select appropriate locations in the urban area to set up public advertising boards.
Posting advertisements (including advertising information) must be posted in the public *** advertising column. Article 14 The placement of outdoor advertisements in key areas and locations will be subject to bidding and auction.
Article 15 Outdoor advertisements are not allowed under the following circumstances;
(1) Construction control zones of state agencies, cultural relics protection units, and scenic spots;
(2) People at or above the county level Areas stipulated by the government where outdoor advertising is prohibited;
(3) Obstructing the appearance of the city, the use of transportation facilities, communications, power supply, and landscaping;
(4) Using the People's Republic of China ***Japanese flag, national emblem, and national anthem sound;
(5) Containing obscene, superstitious, absurd, and ugly content;
(6) Using national-level, most popular Advertising terms such as high-end, best, first, rejuvenation, etc.;
(7) Rough and unsightly pictures;
(8) Derogating similar products;
(9) Other situations prohibited by laws and administrative regulations. Article 16 Anyone who violates Paragraph 1 of Article 4 of these Measures and sets up outdoor advertisements without authorization shall be ordered to dismantle them within a time limit by the municipal urban construction management department. Anyone who violates Paragraph 2 of Article 4 of these Measures and publishes outdoor advertisements without registration shall have their illegal gains confiscated by the industrial and commercial administration department and dismantled within a time limit. Article 17 For those who violate the provisions of Article 5 of these Measures, the administrative department for industry and commerce may order them to complete the change procedures, or order them to stop publishing advertisements and cancel their registration certificates. At the same time, they may be punished in accordance with relevant national regulations. Article 18 Anyone who violates the provisions of Articles 7, 8 and 15 of these Measures shall be punished in accordance with relevant national regulations.
