Exclusive license and exclusive license of patent right

Legal analysis: Exclusive license means that the licensee not only has the right to exploit a patented technology within the specified time and territory, but also has the right to refuse any third party, including all others including the licensor, to exploit the technology within the specified time and territory.

Exclusive license is also called exclusive license, that is, in a certain area, the licensor only allows the licensee to exploit its patent in that area, but still has the right to exploit it in that area. That is to say, an exclusive license is basically the same as an exclusive license except that it cannot exclude the licensor's own implementation.

Legal basis: Article 12 of the Patent Law of People's Republic of China (PRC), where any unit or individual exploits another person's patent, it shall conclude an exploitation license contract with the patentee and pay the patentee the exploitation fee. The licensee has no right to allow any unit or individual other than those stipulated in the contract to exploit the patent.
