Regulations of Shaanxi Province on the Management of Crop Seeds

Chapter I General Provisions Article 1 In order to strengthen the management of crop seeds, improve seed quality, safeguard the legitimate rights and interests of seed breeding, production, management and users, and promote agricultural development, these Regulations are formulated according to the situation of this province. Article 2 All units and individuals that cultivate, produce, manage and use crop seeds within the administrative region of this province must abide by these regulations. Article 3 The term "crop seeds" as mentioned in these Regulations refers to seeds, fruits, roots, stems, seedlings, buds and other propagating materials used for planting crops such as grain, cotton, oil, hemp, sugar, fruit, mulberry, tea, melon, vegetable, tobacco, fungus, grass, pasture, green manure and flowers. Article 4 The agricultural administrative department of the province manages the work of crop seeds in the whole province, and the agricultural administrative departments of prefectures (cities) and counties (cities, districts) manage the work of crop seeds within their respective administrative areas, and are responsible for the planning and layout of improved varieties, breeding, introduction, testing and quality inspection, and uniformly issue crop seed production licenses, seed business licenses and seed quality certificates.

The provincial crop variety approval committee and the regional (city) crop variety approval team are responsible for the approval of new varieties.

Crop seed company is the main business unit of seeds, responsible for the production, processing, distribution and adjustment of improved varieties. Article 5 People's governments at all levels shall strengthen leadership over seed work, implement laws and regulations on seed work, encourage scientific research on seeds, continuously improve the management level of seed work, gradually realize regionalization of seed distribution, specialization of seed production, mechanization of processing and standardization of quality, and organize seed supply in a planned way. Chapter II Germplasm Resources Management and Variety Breeding Article 6 The collection, collation, preservation, identification and utilization of agricultural germplasm resources in the whole province shall be organized by the Provincial Academy of Agricultural Sciences for relevant scientific research and teaching units. Seventh introduction of crop varieties and germplasm resources from abroad and outside the province, must go through quarantine procedures, register with the germplasm resources preservation unit, and pay an appropriate amount of seed preservation and utilization.

The exchange of germplasm resources with foreign countries is limited to the Catalogue of Foreign Exchange of Crop Varieties in China promulgated by the state. Article 8 The source of new varieties should pay equal attention to breeding and introduction. Encourage and support agricultural scientific research, teaching, agricultural technology and seed departments and individuals at all levels to select and introduce new crop varieties. Article 9 The research on the breeding of new varieties of main crops and their application technologies shall be included in the scientific research plan, and the agricultural scientific research management department shall organize the implementation, and select new varieties with high and stable yield, high quality, early maturity and strong stress resistance in a planned way. Chapter III Variety Approval Article 10 New crop varieties across regions shall be approved by the Provincial Crop Variety Approval Committee; Varieties belonging to the region shall be examined and approved by the regional (city) crop variety examination and approval team, and reported to the provincial crop variety examination and approval committee for the record. Eleventh new varieties must be organized by the administrative department of agriculture regional test and production demonstration. When examining and approving varieties, we must first examine and approve the variety standards. New varieties that have passed the examination and approval shall be issued with certificates by the provincial crop variety examination and approval committee, and shall be announced and promoted by the agricultural administrative department at the same level. Twelfth varieties without approval, no unit or individual may distribute, publicize, reward and promote.

Without approval, it is necessary to expand the test and production demonstration of the strain, which shall be reported to the agricultural administrative department at or above the county level for approval and carried out in the designated area. Chapter IV Seed Production Article 13 People's governments at all levels shall raise seed funds, adopt measures such as state support and self-financing by seed companies, and gradually reach the national standard of self-financing for seed production. Fourteenth people's governments at all levels should develop state-owned original (good) seed farms, state-owned farms and specialized seed production households in a planned way, establish seed bases and implement specialized seed production. Seed bases should be relatively concentrated, with improved seed production and technical conditions, and no plant quarantine objects. The seeds of the base shall be processed and meet the seed quality standards stipulated by the state or province. A seed company shall sign an acquisition contract with a seed production unit or individual in accordance with the relevant provisions of the Economic Contract Law of the People's Republic of China. Fifteenth farmers, mainly breeding improved varieties, are really unable to complete the contract of ordering grain because of the sale of improved varieties, and are allowed to sell the goods on credit with the approval of the administrative department of agriculture. Article 16 Units and individuals that produce commercial seeds must have the technical force, breeding facilities and seed production conditions suitable for the task of seed production, and the competent agricultural administrative department of the people's government at or above the county level in the place where the seeds are produced shall issue the seed production license. Article 18 A seed company shall organize parent reproduction and seed production in a unified way, and organize seed supply in a planned way. Chapter V Seed Management Article 21 Breeding units and individuals may engage in various forms of joint ventures with seed production, management and other relevant units on new varieties that have passed the examination and approval, and the profits shall be transferred with compensation or shared with the state in accordance with the Patent Law of People's Republic of China (PRC) and relevant regulations on technology transfer.
