What are the conditions for granting American design patents novelty?

If the design applied for authorization is substantially the same as the previous design (it is not required to be exactly the same), the design in the application is not novel; If not, the design in application is novel.

The design application filed by the applicant in other member countries of the Paris Convention for the Protection of Industrial Property and the Agreement on Trade-related Aspects of Intellectual Property Rights (TRIPS) enjoys the priority of six months in the United States, that is, the international priority. After filing a patent application for the first time in the United States, the applicant can file a new patent application for design within one year, and enjoy the filing date of the previous patent application without losing the novelty of the application, that is, the domestic priority in the United States.
