Can the patentee give up the patent right?

After the patent is granted, can the obligee take the initiative to apply for abandonment?

The patentee may voluntarily give up the patent right. Those who voluntarily give up the patent right shall make a written statement using the form formulated by China National Intellectual Property Administration. Abandoning the patent right can only give up all of a patent, and the statement of giving up part of the patent right is regarded as not being put forward. Abandoning the patents of more than two patentees shall be subject to the consent of all patentees. If some obligees give up the patent right, they shall go through the procedures for changing the specification.

In addition, if the patentee fails to pay the annual fee according to the regulations, the patent right will be terminated in advance, which is equivalent to the patentee giving up the patent right.
