Registration conditions of patent agents

The registration conditions for patent agents are as follows:

1, with full capacity for civil conduct.

2. Obtain a college degree or above in science and engineering recognized by the state, and obtain a diploma or degree certificate.

3. China citizens who have been engaged in patent examination for seven years may apply for exemption from patent agency practice.

Provisions on patent agent's application for examination.

"Measures for the Implementation of Patent Agent Qualification Examination" Article 5 The patent agent qualification examination shall be held once a year, and the national unified proposition shall be implemented. The scope of the proposition is subject to the examination outline. The exam includes the following subjects:

(1) Knowledge of patent law.

(2) Relevant legal knowledge.

(3) Patent agency practice.

Article 6 The examination is a closed-book examination and adopts computerized examination.

Article 7 The examination shall be graded uniformly throughout the country. The organization and coordination of marking shall be the responsibility of the examination committee office.

Article 8 Candidates who have passed all subjects within three years will be awarded the China National Intellectual Property Administration Patent Agent Qualification Certificate after passing the examination.

A patent agent shall meet the following conditions when applying:

1, 18 years old or above, with full capacity for civil conduct.

2. University graduates in science or engineering or related majors.

3, familiar with the patent law and related legal knowledge.

4, engaged in scientific and technical work or legal work for more than two years.

Responsibilities of professional agents:

1. Write files to extract technical features that need to be protected.

2. Handling all procedural matters of patent application on behalf of others.

3. Handle all infringement lawsuits and invalid matters on behalf of others.

4. Provide enterprises with intellectual property strategic planning, and protect and evade intellectual property rights.

5. Trade secrets, unfair competition, copyright and software copyright registration.
