If you are still within the legally stipulated time limit for the international patent PCT application route, you can still apply for a PCT international patent.
PCT patent application process and deadline:
1. To file an application, the applicant can file an application in Chinese with the State Intellectual Property Office of China within 12 months from the filing date of the earlier Chinese application. File a PCT international application and claim priority in China without submitting priority certification documents.
2. The applicant can choose a PCT member country and apply for its national patent to the patent office of that country before the expiration of 30 months from the priority date. When a PCT international application enters the national phase, the application documents need to be translated into the official language of the applicant country. (Utility model patents in most foreign countries can be authorized without substantive examination. Some countries do not have utility model patents: such as the United States, Canada, and the United Kingdom, and these countries are responsible for applying for invention patents).
Notes for PCT international patent applications:
1. Applicants applying for foreign patents must first submit a patent application to the China Patent Office, and then apply for foreign patents
2. Applicants can apply for Chinese and foreign patents through the PCT channel. The applicant can file a PCT international application for the first time, and the designated country of the application should include China.
3. PCT international applications can only be invention or utility model patents, and design applications cannot be submitted through the PCT. 4. Patent applicants can only apply for patents through the PCT and cannot directly Obtain a patent through PCT. To obtain a patent from a certain country, the applicant must also complete the procedures for entering that country. The patent office of that country will review the patent application. If it meets the requirements of the patent law, the patent right will be granted.
