There are generally two methods of contracting for real estate construction projects: direct contracting and bidding. Direct contracting of construction projects refers to the contracting method in which the contract issuing party directly selects a specific contractor, conducts one-on-one negotiations with it, and after reaching an agreement on the rights and obligations of both parties, signs a construction project contract with it. This method is simple and easy to implement and saves contracting costs, but it lacks the advantages brought by competition. Under the conditions of market economy, this method of contracting should only be applicable to a small number of special construction projects that are not suitable for contracting through bidding.
According to the provisions of Article 66 of my country's "Tendering and Bidding Law", special circumstances involving national security, state secrets, emergency rescue and disaster relief, or the use of poverty alleviation funds to implement work-for-relief, or the need to use migrant workers, are not suitable. Projects subject to tendering may not be subject to tendering in accordance with relevant national regulations. In addition, Article 8 of the "Regulations on the Scope and Scale Standards of Bidding for Engineering Construction Projects" stipulates that if the survey, design, use of specific patents or proprietary technologies for a construction project, or if there are special requirements for its architectural artistic modeling, it must be approved by the project competent department. No tendering is required. Article 10 of the "Measures for the Administration of Tendering and Bidding for Construction of Housing Construction and Municipal Infrastructure Projects" stipulates that if a project has one of the following circumstances, it may not conduct construction bidding with the approval of the construction administrative department of the local people's government at or above the county level: ① Construction is suspended or Unit projects that resume construction after postponement, and the contractor has not changed; ② Projects built by the construction enterprise for its own use, and the qualification level of the construction enterprise meets the project requirements; ③ Additional small-scale auxiliary projects or main additions to the project under construction Project, and the contractor has not changed; ④ Other circumstances stipulated in laws, regulations, and rules.
