Pesticide registration regulations

article 1 according to the relevant provisions of the environmental protection law of the people's Republic of China (for trial implementation). In order to protect the environment, safeguard people's health, promote the development of agriculture, forestry and animal husbandry, and strengthen pesticide management, these provisions are formulated. Article 2 All kinds of pesticides (including chemical pesticides, processed preparations and biopesticides) used to prevent and control diseases, insects, weeds and other harmful organisms in agriculture, forestry and animal husbandry, as well as to regulate plant growth, shall be within the scope of management of these Provisions. Article 3 Pesticides used in China shall conform to the principles of high efficiency, safety and economy. Article 4 All new pesticides produced in China must be registered before they are put into production, and pesticides that have not been approved for registration may not be produced, sold or used. Registration is divided into the following three categories: < P > (1) Variety registration: pesticides with unregistered active ingredients must apply for variety registration;

(2) supplementary registration: for pesticide varieties whose active ingredients have been registered, if the dosage form (including content change) or the application scope is changed, an application for supplementary registration shall be made. Other units put into production registered varieties and dosage forms, and report them to the Ministry of Agriculture for the record after approval by the Ministry of Chemical Industry;

(3) temporary registration: where pesticides are demonstrated in the field or used under special circumstances, they must apply for temporary registration. Article 5 The following materials and samples shall be provided when applying for pesticide variety registration.

(1) Information

1. Overview: name, structural formula, composition and main physical and chemical properties of the original drug and preparation;

2. production technology: a brief description of raw materials, production process route and three wastes treatment;

3. product standards: technical conditions, inspection rules, inspection methods, packaging, marking, storage conditions and time limit, and transportation precautions;

4. Application technology: efficacy, phytotoxicity, application method and scope, control targets, labels and instructions, etc.

5. Toxicity: acute, subacute, chronic toxicity and teratogenic, carcinogenic and mutagenic test results;

6. Residues: residues, metabolism, degradation and analysis methods in crops and their products, and suggestions on food hygiene, labor hygiene and safe use;

7. Environmental quality impact: pollution impact on the atmosphere, water, soil, plants and ecosystems.

Article 6 When applying for registration of pesticide varieties, all units shall provide information and samples in quadruplicate according to the provisions of Article 5. After the Ministry of Chemical Industry reviews its production technology and product standards, the toxicity and allowable residues of the Ministry of Health, the impact of the the State Council Environmental Protection Leading Group on its environmental quality, and the application effect and safe use of the Ministry of Agriculture, and signs opinions (or the departments entrust the relevant units to review), the Ministry of Commerce puts forward requirements for its product quality and packaging specifications, and then the pesticide registration and evaluation committee makes a comprehensive evaluation. Those who meet the requirements will be issued a registration certificate by the Ministry of Agriculture. Article 7 Foreign manufacturers selling pesticides to China must register, and products without approval and registration are not allowed to be imported. When applying for registration, materials and samples other than production technology shall be provided in accordance with the provisions of Article 5, and the information on application effect and residue shall have the test results in two representative areas of China for more than two years. To change the dosage form or change the scope of use, you must apply for supplementary registration. Foreign pesticides are registered in China for five years. Article 8 The field efficacy trials of foreign pesticides in China shall be conducted in accordance with the Administrative Measures of the People's Republic of China and the Ministry of Agriculture on Field Efficacy Trials of Pesticides by Foreign Companies in China (for Trial Implementation). Foreign pesticides conducting large-scale demonstration trials in China shall apply for temporary registration. Article 9 In case of emergency, the Ministry of Agriculture may negotiate with relevant departments to approve the use of some pesticides with special uses and some pesticides that have been restricted or banned (including temporary import) within a certain range and period. Article 1 Any pesticide that is proved to be seriously harmful to the environment, people, livestock and other beneficial organisms shall be considered by the pesticide registration review committee and put forward suggestions for proper treatment, and the Ministry of Agriculture shall announce the restriction of use or cancellation of registration. Eleventh before the promulgation of these Provisions, the varieties of pesticides produced in China should be reviewed by stages and batches, evaluated and registered. Article 12 The pesticide registration review committee is led by the Ministry of Agriculture, and its task is to evaluate the pesticide varieties applied for registration, and make suggestions on the principles and policies of pesticide management in China. Members are composed of pesticide management and technical experts appointed by agriculture, chemical industry, health, environmental protection, commerce, forestry and other departments, with a term of three years. Thirteenth examination and approval units and relevant personnel have the responsibility to keep technical secrets for the information and samples provided by the applicant. Fourteenth pesticide registration fees need to be paid. Fifteenth the specific work of pesticide registration shall be the responsibility of the pesticide inspection institute of the Ministry of Agriculture. Article 16 These Provisions shall be implemented as of October 1st, 1982.
