1. If a Taobao penalty notice has been issued, there will generally be an appeal channel.
2. At this time, the difference between the other party’s patented design and the pictures used by us should be analyzed. There are usually two situations:
① If the pictures are exactly the same or similar , it is necessary to examine the time relationship between the other party’s design patent rights and our design patent rights. When our design patent application date is earlier than the other party’s, we can invalidate the other party’s patent rights.
② If the other party’s patent rights are earlier than ours, we can negotiate with the other party for authorization or compensation.
