Can the rejected patent application be used as the basis of priority?
Of course. As the basis of domestic priority, the earlier application must be a formal national application, which means that the application is formally accepted and given the application date and application number. Whether the application is withdrawn, rejected, divided or regarded as withdrawn does not affect the validity of the application as a formal application that generates priority. However, those who have been approved to grant patent rights shall not be used as the basis for claiming domestic priority, so as to avoid repeated authorization.
