According to the Patent Law of People's Republic of China (PRC), the design has been preliminarily examined by the intellectual property department. The intellectual property department decided to grant patents and certificates and help register patents. The patent right shall take effect from the date of authorization announcement.
The patent right is valid for ten years from the date of application. According to the Patent Law and its implementing rules, the legal holder of a patent must pay an annual fee. The annual fee for this patent shall be paid before February 5th/kloc-0 every year. If the legal holder of the patent can't pay the annual fee according to the regulations, the patent right will be invalid as long as the annual fee expires.
The legal status of the registered patent right is recorded on the patent certificate. The register records the transfer, pledge, expiration and withdrawal of the patent right, as well as the change of name, nationality and address.
