1. According to our country’s regulations, claims are an application document that must be submitted when applying for invention patents and utility model patents. It is the content claimed for protection by an invention or utility model patent and has direct legal effect. It is the core of patent application and an important legal document for determining the scope of patent protection. The applicant can fill in or write it by himself or entrust a patent agency to handle it for him.
2. The "Declaration of Claim" shall be signed and sealed in accordance with the regulations, and the signature and seal shall be completely consistent with the name or title filled in the request. The signature may not be copied. Procedures involving the transfer of rights must be signed and sealed by all applicants. Other procedures may be handled by the applicant's representative. If a patent agency is entrusted, the signature and seal of the patent agency shall be handled.
3. The application documents should be arranged in the following order:
(1) Request, abstract of the description, drawings of the abstract, claims, description, and drawings of the description. Each part of the application document should be numbered sequentially with Arabic numerals.
(2) The paper quality should be equivalent to the quality of copy machine paper. There should be no useless words, marks, frames, lines, etc. on the paper. Paper must be A4 size (210 mm × 297 mm).
(3) Paper should be used vertically. The text should be arranged from left to right, leaving 25 mm of margin on the left and top of the paper, and 15 mm of margin on the right and bottom of the paper to facilitate publication and review. The first page must use the form uniformly formulated by the State Intellectual Property Office. This form can be obtained from the information desk in the reception hall of the Patent Office, or from the Patent Office agencies in various places, or downloaded directly from the website of the State Intellectual Property Office, or obtained by letter (send the letter to: Preliminary Examination and Examination of the Patent Office of the State Intellectual Property Office) Documentation Office of Process Management Department). One copy of each page.
(4) White paper of the same size and quality can be used for the continuation pages. Use the front side of paper only. All parts use Chinese characters. If there is no unified Chinese translation of foreign names, place names and scientific and technological terms, the original text should be indicated in brackets after the Chinese translation.
