Appearance design refers to a new design with aesthetic feeling and suitable for industrial application based on the shape, pattern or combination of products and the combination of colors, shapes and patterns. The scope of protection of the design right of a design patent is represented by pictures or photographs. No unit or individual may copy the patent, otherwise it will constitute infringement.
When applying for a patent for design, the applicant is generally required to declare what kind of product the design is used on, and this patent right should be limited to its scope of application. Using the same or similar designs on products that are not within the scope of design does not constitute infringement.
