How to put forward public examination opinions on patents? What are the procedures, costs and objectives?

1. cannot make public comments on the patents that have been authorized. However, you may request the Patent Reexamination Board to declare this patent invalid.

Where a request for invalidation of a patent is made, a request for invalidation of the patent right and necessary evidence shall be submitted to the Patent Reexamination Board in duplicate. The request for invalidation shall, in combination with all the evidence submitted, specify the reasons for the request for invalidation (see Article 65 of the Detailed Rules for the Implementation of the Patent Law for the reasons for invalidation) and indicate the evidence on which each reason is based.

Fee for invalidation: Invention 3000, utility model and design 1500.

2. For an unauthorized patent application under review, you can submit public opinions to China National Intellectual Property Administration.

The writing of public opinions can refer to the format of the request for invalidation, explain the reasons and provide corresponding evidence (the reasons can refer to the reasons for invalidation).

There is no charge for public opinions.

Note: A. The Patent Office will not inform the person who put forward the opinion about the handling of the opinion. B, if the examiner receives the public's opinions after issuing the notice of granting the patent right, the examiner will not consider it.
