What are the common problems in patent trading?

Patent transaction mainly refers to the change of rights: refers to the change of application right/patent right.

I. Change of rights

1. Where changes are proposed due to the transfer/gift of rights, the transfer/gift contract shall be submitted.

The contracting unit shall affix its official seal, personal signature or seal. Multiple applicants (or patentees)? Where the obligee agrees to transfer or donate, it shall submit the certification materials.

2. For transfers involving foreigners, foreign enterprises or other foreign organizations, please refer to the provisions of Article 2 and pay special attention to:

For an application for a patent (or patent) for invention or utility model, if the transferor is an individual or unit in China (including the transferor together with Hong Kong, Macao and Taiwan/foreign countries) and the transferee is a foreigner, a foreign enterprise or other foreign organization/individual/enterprise/other organization in Hong Kong, Macao and Taiwan Province Province, a technology export license or a certificate of free technology export contract issued by the competent department of commerce in the State Council shall be issued.

Unit merger, division, cancellation or change of organizational form.

Submit the certification documents issued by the registration administration department.

Second, about the time and cost of payment:

Payment time: within one month from the date of request. Failing to pay or not paying in full at the expiration of the period, it is deemed that the project declaration for filing has not been submitted.

Official expenses to be paid:

Change fee for changing the description items of the inventor and/or applicant (or patentee): 200 yuan;

Applications that make continuous changes to the project are considered as one change and only need to pay once.

Third,? Other considerations and complications:

About fee waiver: the applicant (or patentee) needs to resubmit all the changed or increased fee waiver requests. Details are as follows:

Where the applicant (or patentee) enjoys a fee reduction before the change,

(1) After all changes, the changed applicant (or patentee)? Unsolicited cost reduction

If an extension is requested, the fee will not be deferred.

(2) The applicant (or patentee) after the change? Additional applicants (or patentees)? No fee reduction is required, and no fee reduction will be granted.

(3) The applicant (or patentee) after the change? Less, the applicant (or patentee)? If no fee waiver request is made, the fee waiver standard will remain unchanged.

Four, the effective change description items:

( 1)? The change procedures of recorded items shall take effect as of the date when the Patent Office issues the notice of qualified procedures. Patent application right (or patent right)? The transfer shall take effect from the date of registration, that is, the date of issuance of the above-mentioned conformity notice.

(2)? Before the change procedure of cataloging items takes effect, the notice issued by the Patent Office and the relevant matters that have entered the preparation stage of patent publication or announcement shall still be subject to the change.
