What are the types of technology contracts?

A technology contract is a contract that establishes mutual rights and obligations between the parties regarding technology development, transfer, consultation or services. So what are the types of technology contracts?

1. Technology development contract. It refers to a contract entered into between the parties regarding the research and development of new technologies, new products, new processes or new materials and their systems. Including entrusted development contracts and cooperative development contracts. Technology development contracts should be in writing. The parties may enter into a contract with reference to the provisions of the technology development contract regarding the transformation of scientific and technological achievements with industrial application value.

2. Technology transfer contract. It refers to the contract entered into by the parties regarding the transfer of patent rights, transfer of patent application rights, transfer of non-patent technology, patent implementation license and technology introduction. Including patent right transfer, patent application right transfer, technical secret transfer, and patent implementation license contract. Technology transfer contracts should be in writing.

3. Technical consulting contract. It refers to a contract in which one party provides consulting services such as feasibility studies, technology forecasts, special technical investigations, analysis and evaluation reports on specific technical projects, and the other party pays consulting fees.

4. Technical service contract. It refers to a contract entered into by one party using technical knowledge to solve specific technical problems for the other party. Excludes survey, design, construction contracts and contracting contracts for construction projects.
