Foreign-related notarization refers to notarization matters with foreign-related factors handled by notary organs. That is to say, the notarized parties, the object of proof or the place where the notarial certificate is used include at least one notarial matter involving foreign factors, which mainly refers to the notarial matter that the notarial certificate will be sent abroad for use. Foreign notarization has the following characteristics: 1, and most of the parties are foreigners, overseas Chinese, compatriots from Hong Kong, Macao and Taiwan, or citizens preparing to go abroad; 2. Notary offices approved by the Ministry of Justice to handle foreign-related notarization business and foreign-related notaries who have passed the examination are responsible for handling it; 3. According to the Provisional Regulations on Notarization and international practice, China's notary organs mainly handle the following foreign-related notarization services: (1) notarization of foreign-related economic contracts, various agreements and contracts; (two) notarization of foreign adoption, inheritance, will, entrustment, gift, property division, property transfer, guarantee and other legal acts; (3) To notarize the articles of association, equity certificates, authorization certificates, credit certificates, patent certificates, trademark registration certificates, business certificates, resolutions of the board of directors and other foreign-related or overseas economic and legal documents; (4) Proof of legally significant facts such as marital status, kinship, identity, legal personality, birth, death, survival, education, experience, no criminal punishment, accident, etc.; (5) Providing necessary notarial certificates for foreign-related litigation, claims, establishment of institutions, application for patent registration and legal protection; (six) to handle foreign-related evidence preservation, heritage inventory, escrow and other notarization services; (seven) to prove that the signature and seal on the document are true, the contents of different documents are consistent, and the place and date of signing the document; (eight) according to international practice and the application of the parties, handle other foreign-related notarization business.
