What works are protected by copyright law? The object of copyright is literary and artistic works. Therefore, as long as you have a certain literary and artistic form, you may become the object of copyright protection. The protection of copyright law in China is similar to that in other countries, which mainly includes the following contents: 1, written works, and Article 4 of the implementing regulations stipulates that written works refer to novels, poems, essays, papers and other works expressed in written form. (3) Quyi works Quyi is a unique art form in China. Quyi works stipulated in Article 4 of the Regulations for the Implementation of Copyright Law in China refer to works with rap as the main form of expression, such as cross talk, fast writing, drum, storytelling, etc. It can appear in written or oral form. (4) Dance works refer to works that express thoughts and feelings through continuous movements, postures and expressions. Dance is the art of human action. Broadly speaking, it is an art form to express feelings by means of organized, regular and organized movements of the human body. (5) Acrobatic art refers to acrobatics, magic, circus and other works expressed through body movements and skills. As a kind of acrobatic performance, China is rich in acrobatic art resources, so acrobatic art is defined as the object of copyright protection when it is revised. Copyright law only protects the artistic elements of acrobatics, and the difficulty and skills of acrobatics are not protected by copyright law. 4. Art and architectural works (1) Art works refer to plane or three-dimensional plastic art works with aesthetic significance, such as painting, calligraphy and sculpture, which are composed of lines, colors or other ways. Generally, it is divided into pure works of art and practical works of art, and practical works of art refer to works of art with practical use value and are a kind of plastic arts. Practical works of art are not only material products, but also works of art with material practical and aesthetic functions. In the art world, there are different opinions on whether practical art belongs to works of art. Article 2 of Berne Convention stipulates that the legal protection of practical works of art should be decided by each country. If industrial property rights are not protected, at least they should be protected by copyright law. But now, practical works of art can be protected as works of art in China. If you apply for patent protection for appearance, you can use industrial property rights to protect it. (2) Architectural works Architectural works refer to works of aesthetic significance in the form of buildings or structures. Architectural works are works expressed in three-dimensional form. Copyright law gives legal protection to the building itself as one of the forms of works. Works protected by copyright law must be original and reproducible, while popular buildings that are widely used are not exclusive, such as the shape of banlou, so they are not protected by copyright law. Buildings with original appearance, decoration and design are protected by China's copyright law, but building materials and construction methods are not protected. The common elements in building appearance, decoration and design belong to the public domain and are not protected by China's copyright law. The protection of architectural works should also include architectural design drawings, renderings and architectural models. However, according to the list of works in China's copyright law, these works are protected as graphic works and model works. Copyright Law Article 3 The term "works" as mentioned in this Law includes works of literature, art, natural science, social science and engineering technology created in the following forms: (1) written works; (2) Oral works; (3) Music, drama, folk art, dance and acrobatic works; (4) Artistic and architectural works; (5) Photographic works; (6) cinematographic works and works created by similar cinematographic methods; (seven) engineering design drawings, product design drawings, maps, schematic diagrams and other graphic works and model works; (8) Computer software; (9) Other works as prescribed by laws and administrative regulations. Copyright law mainly regulates and adjusts works. If disputes arise in this respect, they can also be resolved according to the provisions of copyright law and relevant judicial interpretations and provisions.
