The technology patent application process is as follows:
1. Write patent application documents, prepare application documents, submit patent applications and obtain patent application numbers.
2. Acceptance. Relevant institutions that meet the acceptance conditions will accept the application.
3. Preliminary review. After entering the preliminary examination and passing the examination, the invention patent application will be published in the patent gazette and website 18 months after the filing date.
4. Substantive review. The applicant may file a substantive examination with the Patent Office at any time within 3 years from the date of application.
5. After substantive examination, the patent meets the practicality, novelty, and creativity of the invention, and the patent right is granted. The patent application maintenance fee, annual fee, printing fee, and certificate production fee are paid as required, and the patent is obtained. Invention patent certificate; authorized invention patents will be announced.
Legal Basis
Article 3 of the "Patent Law" states that the Patent Administration Department of the State Council is responsible for managing patent work nationwide; it uniformly accepts and examines patent applications and grants patent rights in accordance with the law.
The patent management departments of the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government are responsible for patent management within their respective administrative regions.
